A list of State Private Universities as per information available in UGC office is attached as Annexure-I. 2. Criterion to recognize Private UGC does not recognize Universities. UGC makes Universities. inspection of the Private Universities for the assessment of Infrastructure & academic facilities available in the Private Universities. 3. Controlling features by UGC on Private UGC has farmed regulation UGC (Establishment of Universities. and Maintenance of Standard in Private Universities) Regulation, 03 to control the functioning of Private Universities. A copy of UGC Regulation is attached as Annexure-II 4. Is UGC aware of dual fees-structure in No reply private Universities like additional heavy fees charged by Amity University from students admitted in name of ‘Sponsored’ category? If no, what steps UGC will take to make private Universities have a single and common fees structure charged by the private Universities? If yes, kindly gives the details. 5. Any other available information No. regarding Private Universities recognized by UGC.

The First Appellate Authority Ordered:
The Appellate Authority had been ordered “UGC has not formulated any dual fees structure in Private Universities. However, the Chairman, UGC has constituted an Expert Committee to frame regulation for admission and fee structure in Private and self financed University including deemed University. These regulations, as and when finalized shall be placed before the Commission. If approved by the Commission, the regulations shall be sent to the Govt. of India for its concurrence which is mandatory for notifying and implementing the regulation.”

Relevant Facts emerging during Hearing: The following were present Appellant: Mr. Subhash Chandra Agarwal Respondent: Mrs. Parvati Bose representing Mr. A.K.Dogra Jt. Sec. and PIO The appellant stated that the main issue was that point no. 4 had not been answered at all. “Is UGC aware of dual fees-structure in private Universities like additional heavy fees charged by
Amity University from students admitted in name of ‘Sponsored’ category? If no, what steps UGC will take to make private Universities have a single and common fees structure charged by the private Universities? If yes, kindly gives the details.” The respondent states that UGC is not aware of dual fee structure in private Universities and UGC has not taken any steps to have a single fee structure for private Universities so far. The respondent states that a Committee has been appointed to frame regulations for admission and fee structure in Private and self-financed Universities, including deemed Universities.

Decision: The appeal is allowed. The PIO will give a written reply stating what has been said before the Commission by the respondent before 10 December, 2008. This decision is announced in open chamber. Notice of this decision be given free of cost to the parties
