CHAPTER 1007: BOCA NATIONAL BUILDING CODE ADOPTION
1007.01 Adoption and Purpose 1007.02 Changes Specified

§ 1007.01 ADOPTION AND PURPOSE: There is hereby adopted by the City of Pittsburgh, for the purpose of
prescribing regulations governing the construction, alteration, repair, removal, demolition, use, location,
occupancy and maintenance of all buildings and structures, that certain code known as the BOCA National
Building Code as promulgated and recommended by the Building Officials and Code Administrators International,
Inc., being particularly the 1999 Edition, except such portions thereof as changed by Paragraph 1007.02. Copies of
such code are on file with the City Clerk and the Bureau of Building Inspection for public inspection. The code is
hereby adopted and incorporated as if fully set out at length herein, except such portions thereof as are changed by
Paragraph 1007.02.
§ 1007.02 CHANGES SPECIFIED: The BOCA National Building Code adopted by Paragraph 1007.01 is
hereby changed by the enactment, repeal or amendment of provisions, which charges are on the following pages,
with the location in the code for that page noted by the heading “Change(s) - Page(s)”.

Note b. Electrical and Mechanical permits for Use Groups R-3 and R-4 may be obtained in conjunction with the
Building permit with the fees for the Electrical and Mechanical permits added to the Building permit fee.
The signatures of the Electrical and Mechanical Contractors will not be required, but the work must be
installed in accordance with applicable City of Pittsburgh registration or licensing requirements.

Note c. A separate fee for the Electrical work required for each Fire Suppression System will be charged in
addition to the permit fee for the system. See Chapter 9 for the systems included in this requirement.

Note d. • Each independent surface of a sign is considered as a separate sign.
• The moving of a sign to a different location on the same property or to a different property shall
be considered a new installation with the fee charged accordingly.
• A separate fee will be charged for each sign on a single supporting structure.
• An existing sign which is increased in size shall be charged the same fee as a new sign with the
same area as the enlarged sign.

Note e. All items of work included in the International Mechanical Code, as changed by the City of Pittsburgh,
shall be subject to the Mechanical Permit Fee.

Note f. Christmas or seasonal display renewal fee shall be equal to the fee for alterations and repairs for signs.

Section 116.4: Delete and replace with the following:
116.4: Violation and penalties: Any person who shall violate a provision of this code or shall fail to
comply with any requirement thereof or who shall erect, construct, alter or repair a building or structure in
violation of an approved plan or directive of the code official, or of permit or certificate issued under the
provisions of this code shall be penalized as provided in Title 10, Chapter 1001, Section 1001.10.
Section 117.2: Delete and replace with the following:
117.2 Unlawful continuance: Any person who shall continue any work in or about the structure after
having been served with a stop work order, except such work as that person is directed to perform to remove
a violation or unsafe condition shall be subject to the provisions of Title 10, Chapter 1001, Section 1001.10.
Section 118.3: Delete and replace with the following:
118.3 Existing structures: A certificate of occupancy shall be required for any building or structure used
otherwise than as a one family dwelling when the code official deems an official record of its occupancy
necessary. Upon application from the owner of an existing building or structure, and upon approval by the
Zoning Administrator, the code official shall issue a certificate of use and occupancy, providing there are no
violations of laws or orders of the code official pending, and it is established after inspection and investigation
that the alleged use of the structure has heretofore existed. The code shall not require the removal, alteration or
abandonment of or prevent the continuance of, the occupancy of a lawfully existing building or structure, unless
such is deemed to endanger the public safety and welfare.

Section 118.4: Delete and replace with the following:
118.4 Certificate of occupancy: When a structure is entitled thereto, the code official shall issue a
certificate of occupancy within ten days after written application. Upon completion of the final inspection

in accordance with Section 113.3 and correction of the violations and discrepancies, the certificate shall be
issued.

Section 121.0: Delete in its entirety and replace with the following.
SECTION 121.0 MEANS OF APPEAL
121.1 Types of appeals: Appeals and related matters shall be heard by the “Board of Standards and
Appeals”, hereinafter referred to as the board, which shall meet for the following purposes:
1. To hear appeals from decisions of the code official.
2. To hear appeals for permission to use a requested alternative/equivalent in lieu of a provision of
the code when the appellant believes that a strict application of the code provision would result
in undue hardship, and that the requested alternative/equivalent will not reduce the level of life
safety, public health and general welfare required by the code. An appeal based on cost will not
be entertained.
3. To render interpretations of the provisions of the code.
4. To pass on all matters referred to it by the code official relative to the provisions of the code.

121.2 Membership of the board: The board shall consist of five members as follows: one for a five year
term, one for four years, one for three years, one for two years and one for one year. Thereafter each new
member shall serve for five years or until a successor shall be appointed.
121.2.1 Qualifications: The members of the board shall be registered design professionals who shall
have at least ten years of experience in their profession, five of which shall have been in responsible
charge of work. The members shall either be City of Pittsburgh residents or shall have their principal
office in the city. The members shall not be employees of the City of Pittsburgh. The board shall
consist of five individuals from the following professions:
1. Two architects selected from a list of at least two nominees for each membership submitted by
the Pittsburgh Chapter of the American Institute of Architects.
2. One structural engineer, one mechanical engineer, and one electrical engineer selected from at
least two nominees for each membership submitted by the Consulting Engineers Council of
Greater Pittsburgh (CEC) and the Pennsylvania Society of Professional Engineers (PSPE),
Pittsburgh Chapter.
121.2.2 Alternate members: Two alternate members shall be appointed who shall be called by the
board chairman to hear appeals during the absence or disqualification of a member. Alternate members
shall possess the qualifications required for board membership, and shall be appointed for five years or
until a successor has been appointed.
121.2.3 Chairperson: The board shall select one of its members to serve as chairperson.

121.2.4 Disqualification of member: A member shall not hear an appeal in which that member has
any personal, professional or financial interest.

121.2.5 Quorum: Three members shall constitute a quorum for a hearing.

121.2.6 Advisors to the board: The code official of both the Building Code and the Fire Prevention
Code or a designated member of their staff shall act in the capacity of non-voting technical advisors to
the board. Where an appeal before the Board involves an interpretation of the accessibility provisions of
the building code, the City’s Accessibility Coordinator or designated representative shall act in the
capacity of an additional non-voting technical advisor to the Board.

121.3 Disposition of the code official’s decision pending appeal: When an appeal is taken in accordance
with Section 121.1, a decision or action by the code official shall be stayed until a final decision on the
appeal is rendered by the board.

121.4 Filing of appeal: The appellant shall file for an appeal on the forms furnished by the code official
with such drawings, documents and any other evidence or information required by the code official.
1211.4.1 Fee: Each request for a hearing before the board shall be accompanied by the fee indicated in
Section 112.3.1.
121.5 Meetings: The board shall meet for hearings at the time and place set by the code official. The
hearings shall be open to the public. The appellant and/or the appellant’s representative, the code official
and any person whose interests are affected together with such witnesses as a party shall desire to present
shall be given an opportunity to be heard. No applicable matter as listed in Section 121.1 shall be
adjudicated by the board without a hearing on the matter.
121.5.1 Notice of meeting: The time and place of the public hearing on the matter involved, including
pertinent data, shall be given not less than five days prior to the date of the hearing by the following
methods:
1. Posting a notice of hearing on the main street the subject property fronts with a poster furnished
by the code official.
2. Mailing the notice to all interested parties who have registered with the code official for this
purpose.
3. Publishing of the notice in the daily local newspaper.
121.5.2 Record of hearing: A record shall be made of all testimony before the board, board decisions,
and other official actions of the board, and all of which shall be filed in the offices of the Bureau of
Building Inspection as a public record.
121.6 Board decisions: All decisions of the board relative to Items 1 and 2 of Section 121.1 shall be
unanimous. All decisions and interpretations shall be in writing and shall be mailed by certified mail to the
appellant at the address set forth in the appellant’s appeal form.

121.7 Appeal of board decisions: Any person who appeals a decision of the board to Common Pleas Court
shall notify all interested parties who have registered with the code official and appeared at the hearing,
whether they testified or not, that such action has been taken.

403.1 Applicability: The provisions of this section shall apply to all buildings having floors used for
human occupancy located more than six stories or 75 feet (22860 mm) above the lowest level of fire
department vehicle access, below the lowest level of fire department vehicle access, or such combined
maximum above and below the lowest level of fire department vehicle access. The 75 foot space above fire
department access shall be measured to the bottom of the lowest window opening.

emergency, pull fire alarm handle to release door. Alarm will sound.” Actuation of the fire alarm from any

3102.4.3.4 Imbedded signs: Signs imbedded into the building facing, or which are so constructed as to
become a permanent part of the building or structure, provided the signs bear only the name of the owner,
or the building name and/or nature of the business.
3102.4.3.5 Non-illuminated signs not exceeding 24 inches in height: Signs not over 24 inches (609.6
mm) in height mounted flat on wall or other face of building, projecting not more than 6 inches (152.4 mm)
from the mounting surface, not less than 10 feet (3048 mm) above sidewalk, and with the same advertising
contents as listed in Section 3102.4.3.3.
3102.4.3.6 Tablets: Tablets constructed of bronze, brass, aluminum, stone or other non-combustible
material built into or attached to a building face, provided the signs bear only the name of the owner, the
name or use of the building, the date of erection of the building or structure, and/or reading matter
commemorating a person or event.

3102.4.3.7 Public service company signs: Signs indicating danger, ownership of property, or offices and
buildings where services are available to the public, provided signs are mounted flat against the wall of the
building or structure.

3102.4.3.8 Bulletin boards: Boards not exceeding 8 square feet (0.74 m
2
) in area, for religious, charitable
or public institutions, mounted on face of building, or ground mounted on the premises.

3102.4.3.9 Municipal signs: Traffic signs, danger signs, trespassing signs, railroad crossing signs, street
name signs, legal notices, or other municipal signs.

3102.4.3.10 Emergency signs: Signs approved by the Director of the Division of Traffic Engineering.

3102.4.3.11 Public carrier signs: Signs indicating transit stops, signs designating location of transit
lines, and signs indicating route changes.

3102.4.3.12 Real estate signs: Temporary non-illuminated signs, not exceeding 12 square feet (1.12 m
2
)
in area for residential signs and not exceeding 32 square feet (2.97m

) in area for commercial signs,
advertising the sale, rental or lease of the premises on which the signs are erected.

3102.4.3.13 Fabric banners: Temporary fabric banners attached to or suspended under a marquee,
provided no portion of the banners are less than 9 feet (2743 mm) above the sidewalk and not more than
three banners are attached to or suspended under any marquee.

3102.4.3.14 Suspended under marquees: Temporary signs suspended under a marquee, provided no
portion of a sign is less than 9 feet (2743 mm) above the sidewalk, and not more than three signs are
suspended under any marquee.

3102.4.3.15 Attached to marquees: Temporary signs, not exceeding 15 square feet (1.40 m
2
) in area,
attached to a permanent sign, erected on a marquee or to the sides of a marquee provided on portion of such
signs extends below the edge of the marquee.

3102.4.3.16 Construction signs: Signs not exceeding 15 square feet (1.4 m
2
) in area, listing names of
architects, engineers and/or contractors of a building or structure under construction, alteration or repair,
and signs not exceeding 50 square feet (4.65 m
2
) in area, announcing the character of the building
enterprise or the purpose of the building, provided the signs are placed on the construction fence, on a
construction shed, on the roof of the sidewalk shed, or on the building under construction, and provided not
more than one sign is erected on each street frontage.
Section 3102.5.4: Delete and replace with the following:
3102.5.4 Inspection: The code official shall inspect all signs and other structures regulated by this section
for which erection permits have been issued; and shall also inspect at least once a year all signs and other
structures regulated by this section for which maintenance and inspection fees are required.
3102.5.4.1 Maintenance and inspection fees: The owner or user of any sign or other structure
regulated by this section shall pay an annual fee for maintenance and inspection. The fee for
maintenance and inspection shall cover the period from July 1 of a given year to June 30 of the
following year, and payment thereof shall be made before the beginning of such term. If a maintenance
and inspection fee has not been paid for by the owner or user of a sign in compliance with the foregoing
provision, the code official shall have authority to require the owner of the property on which the sign is
located to remove such sign or pay the maintenance and inspection fee required for late payment. If any
portion of a sign or other structure regulated by this section is left standing after removal of any other
portion thereof, payment of the maintenance and inspection fee shall be required in accordance with
Section 112.0, Fees.

Section 3107.1: Add the following new section:
3107.1.1 Permits and applications: The applicant shall obtain from the Zoning Administrator’s office,
the location of the flood hazard area in which the property in question is located and shall submit to the
Zoning Administrator’s office all State and Federal permits required for the permit. After the application
has been approved by the Zoning Administrator, it shall be submitted to the Bureau of Building Inspection
for approval. The code official shall issue the permit provided all applicable requirements of this code, and
any other applicable regulations, are met.
Section 3107.2.1: Delete the last two lines of the paragraph and the associated note and insert in their place:
“areas shall be identified accordingly on the most recent Flood Insurance Rate Map published by the Federal
Emergency Management Agency.”
