Ganun din sa mga kaliit-liitang mga gamit na nawawala. Ngunit, hindi lamang ang mga empleyado nila ang ninanakawang ng kumpanyang ito, kundi maging ang kaban ng bayan. Is another Labor Code revision in the offing?
TWO decades after the Aquino government successfully rammed through the first major revision of the country’s Labor Code to the detriment of workers’ rights, the Employers’ Confederation of the Philippines (ECOP) recently aired its desire to revise it anew. As with previous attempts to change the Labor Code, their stated reasons boil down to the “imperatives of creating jobs to improve the economy.” Their announcement followed the first major public appearance of ex-Senator Ernesto Herrera, leader of the government-backed Trade Union Congress of the Philippines (TUCP). Herrera is the principal author of Republic Act 6715 of 1989, dubbed as the Herrera Law, the first major revision of the Labor Code, which was passed in 1974 during the Marcos dictatorship. It was followed a few weeks later by the “Wage Rationalization Act” or RA 6727, which provided for the creation of regional wage boards, composed of representatives of the government, corporations, and labor, for the purpose of determining wage increases. This, workers asserted, was meant to weaken the national unity and struggle of workers for legislated wage increases. After his role in changing the Labor Code, Herrera lost his reelection bid for the senate. But recently, he came out of hibernation to lead TUCP in the filing of wage hike petitions in some regional boards, while the rest of the labor sector have given up on these “inutile” wage boards and are lobbying instead for a legislated wage hike. What is in store for private sector employees and workers now that the ECOP and TUCP, which progressive unions accuse of conniving to mangle workers’ rights, are again actively pushing for their respective agenda? These two groups, who are favored by the government and the International Labor Organization (ILO), also often represent the two sides of the tripartite body that formulates proposals for labor legislation. Will another round of revisions of the Labor Code result in jobs creation and improvements in the economy, which is reeling from a crisis? Past Labor Code Revisions Made Workers Poorer, More Exploited Experience hardly exhibited what ECOP president Edgardo Lacson said last week, that “the Constitution and the Labor Code have a preferential bias for labor as based on a timehonored principle of social justice observed in almost all democratic countries.” Corporate profits have been rising in double digit rates up to 2007, before the crisis hit the economy. In 2004 the aggregate net profit of the top 1000 corporations in the Philippines increased by 160 percent. In 2006, the top 20 percent of the population, numbering around 3.5 million families account for 52.8 percent or more than half of total family income, while the poorest 80 percent or 13.9 million families have to contend with the remaining 47.3 percent. The income of the top 10 percent is 19 times more than that of the poorest 10 percent. MM experiencing rains, Mindanao floods
THE rainy season is already here as Metro Manila for the past few days is experiencing rains while some parts of Mindanao Island is flooded brought by heavy rains. National Disaster Coordinating Council said about 35,000 people were affected by floods in Mindanao, particularly parts of Sultan Kudarat town in Maguindanao and Cotabato City A report from dzXL radio disclosed that heavy rains poured in Mindanao at around 4 a.m. triggering waist- and neckdeep floods. Several vehicles were stalled in the flashflood on the national highway in Cotabato City . The report also said some 23 of the 37 villages in the city were flooded. Several houses in Bulalo village in Sultan Kudarat town in Maguindanao reportedly were also flooded causing heavy traffic in the area. Earlier, Philippine Atmospheric Geophysical, Astronomical Service Administration said a low-pressure area off Batanes and the "Amihan" (northeast winds) will bring rains to some parts of the country.

Trillanes and others maybe freed soon
DETAINED Sen. Antonio Trillanes IV and several other military officers maybe freed soon following the release from detention on Monday of former Scout Ranger chief Brig. Gen. Danilo Lim. The possible inclusion of Trillanes and other suspected coup leaders -- such as Lim’s fellow defeated senatorial candidate Col. Ariel Querubin and former Marine commandant Maj. Gen. Renato Miranda -- surfaced after Brig. Gen. Reynaldo Ordonez hinted that dozens more suspected renegade officers maybe released if they can get through the same process. “All these things are governed by the regulations. There is a process on how one will get custody of a detainee. Danny went through a process and if the others can do that, I don’t see any reason (why they would not be granted provisional liberty). We will process it according to the regulations,” Ordonez to whom Lim was released said. Lim posted a bail of P200,000 before a Makati City court in connection with a rebellion charge filed against him for the November 2007 siege of the Manila Peninsula Hotel. This paved the way for Lim’s release from a Camp Crame detention facility and his provisional liberty. “The regulations say it applies to anybody. It is not selective. It applies to everybody. Regulations apply to everybody,” said Ordóñez, referring to the Article of War 70 that allows military commanders the discretion to detain or enlarge officers facing trial by court martial. “The grant is the prerogative of the chief of staff and it may be withdrawn actually, especially when there is a gross violation of the conditions which is the attendance of the court martials and the civil court hearings. Ex-DSWD chief wins P1 libel case
FORMER Department of Social Welfare and Development (DSWH) Secretary Corazon “Dinky” Soliman has been acquitted by the Quezon City Regional Trial Court (QCRTC) after the prosecution failed to prove her guilt on the P1 libel case filed by Alagad party list Rep. Rodante Marcoleta. In a 21-page decision, QCRTC Branch 88 Presiding Judge Rosanna Fe Maglaya ruled that “a conviction in a criminal case must rest nothing but certainty of guilt based on the strength of the evidence for the prosecution. As the probative value of the People’s evidence failed to establish guilt beyond reasonable doubt, accused must be acquitted.” Marcoleta filed the case in 2005 after Soliman allegedly issued malicious statements against him during a press conference on August 30, 2005 in Rockwell Center in Makati City . The complainant said that during the said press conference, Soliman had linked him to alleged efforts by Malacañang to manipulate the impeachment proceedings by supporting a defective impeachment complaint against President Gloria Macapagal-Arroyo.

NBI nabs two men for bogus dollars worth P1.8M
NATIONAL Bureau of Investigation (NBI) agents seized a total of US$38,400 in bogus US$100 denominations worth about P1.8 following the arrest of two men during an entrapment operation in Manila . The NBI identified the arrested suspects as Warlito Madrid Jr., of Pasong Kawayan 2, General Trias, Cavite and Felecito Briones Jr., of Area 1, Barangay Libho, Paranaque City . The two were charged with violation of Article 168 of the Revised Penal Code (Illegal Possession and Use of False Treasury or Bank Notes and Other Instruments of Credit). Investigations conducted by the International Police or Interpol Division of the NBI headed by Atty. Claro de Castro Jr. revealed that the bureau received an information regarding a syndicate, led by Roel Santos also known as “Ka Imo,” that is involved in the production, distribution and sale of fake US and Philippine currencies in violation of the Revised Penal Code. In coordination with the personnel of the Investigation Division, Cash Department of the Bangko Sentral ng Pilipinas, the NBI team conducted a buybust operation inside the Times Plaza on UN Avenue corner Taft Avenue, Ermita, Manila. Santos was nowhere in sight during the operation. The suspects were immediately apprehended after they received the marked five P1,000 bills in exchange for the 384 pieces of counterfeit US100 bills. No source yet of ‘Hello Nico’ tape – Comelec
THE Commission on Elections (Comelec) admitted yesterday that it has no clue yet on the source of the supposed taped conversation between Interior and Local Government Secretary Ronaldo Puno and Comelec Commissioner Nicodemo Ferrer on the alleged plot to rig the May 10 automated polls. Comelec chairman Jose Melo said the National Bureau of Investigation (NBI) has been finding difficulty in determining the source of the conversation due to the layers on the website wherein it was originally posted. The Comelec head said the multiple layering only showed that the people behind the website intended to keep their identities secret. He reiterated that Ferrer and the other commissioners were not involved in any plot to manipulate the recent elections. Both Ferrer and Puno had denied talking to each other. Soldiers refused bribe from candidates lauded
MARINE commandant Maj. Gen. Juancho Sabban yesterday disclosed attempts by erring candidates to bribe his men for the railroading of the results of the just-concluded May 10 local elections in the island province of Sulu . Sabban is flying to Sulu today to give awards to the Marine soldiers who turned down the bribe offer “for displaying professionalism and of course dedication (to their duty)” and for “doing what is right.” He identified two of the three recipients of the award for gallantly protecting the integrity of the election as Pfc. Rhomel Divina and S/Sgt. William Magpili. The name of the third one is still being confirmed. Marine spokesman Capt. Alden Gwyn Amargo said Divina was offered P100,000 by an unnamed campaign leader for him to leave the Maligay polling precinct as there were lesser number of voters coming in on the afternoon of May 10 “so he and his cohorts could fill up the more than three hundred remaining ballots for his candidate.” Amargo said at the Baunoh Bangkal precinct, another campaign leader approached Magpili for the tampering of at least 168 ballots. No more buying of street food for Caloocan studes
THE Caloocan City Division Office of the Department of Education (DepEd) ordered school authorities to ban its students from buying street foods being sold by ambulant vendors outside their respective schools once classes re-open. The directive stemmed from complaints received by Caloocan City Mayor Enrico “Recom” Echiverri from pupils’ parents saying that consumption of these street foods have caused sickness on the part of their children. According to Echiverri, it is only right to look after the health of the returning students so that their performance in school would not be affected by having ailments. With this in mind, Division Superintendent Dr. Corazon Gonzales has ordered all school principals in the City of Caloocan to prohibit students from consuming food that have been bought outside school premises. Veterans Bank declares cash dividends
PHILIPPINE Veterans Bank (PVB) announced it has declared cash dividends of eight percent (8%) for preferred and two percent (2%) for common shareholders, in the Bank’s recent annual stockholders’ meeting. Col. Emmanuel V. De Ocampo, PVB chairman, said the cash dividends were approved in the said gathering held at the Veterans Federation of the Philippines compound on Arroceros St., Manila where some 5,000 World War II veterans and their widows & heirs attended. The stockholders’ meeting was also highlighted by the election of the bank’s Board of Directors. Re-elected for another one-year term to the 11-member PVB Board were Col. Emmanuel V. de Ocampo, Ricardo A. Balbido, Jr., Engr. Antonio A. Balgos, Commo. Vicente R. Buenaventura, Atty. Democrito T. Mendoza, Atty. Eduardo P. Pilapil, Gen. Umberto A. Rodriguez, Atty. Romeo G. Roxas, Atty. Ramon P. Miranda, Jose A. Nuñez, Jr. and Col. Francisco T. San Miguel. Ricardo A. Balbido, Jr., PVB president, also reported that PVB had an audited net income of P416.2 million in 2009, slightly higher than the 2008 results of P406.3 million. Balbido cited gains in its core businesses, deposits and lending, as the main drivers behind the bank’s sustained profitability. This was however tempered by the slowdown in the income from securities trading. In terms of total resources, PVB grew significantly last 2009 from P45.1 Billion in 2008 to P51.8 Billion as of December 2009. The increase in PVB’s deposit base to P43 billion from P37 billion was the main contributor to the Bank’s asset growth. PVB President & CEO Ricardo A. Balbido Jr. said that PVB’s Cash Management solutions were the primary products that drove growth of deposits while the loans to LGUs dominated the growth in the asset side. The Bank also opened 15 new branches all over the country expanded its branch network to a total of 60 branches nationwide. The Bank’s capital position likewise improved to P4.99 billion as of December 2009, from P4.74 billion in December 2008. PVB’s CapitalAdequacy Ratio (CAR) remained high at 18.36% despite the bank’s continued growth, still way above the BSP’s minimum of 10%. The CAR is a measure to determine a bank’s capability to shoulder risks. ”For 2010, we foresee a better year and project improved earnings as we see economy picking up now that the May 2010 elections are over.” said Balbido. Philippine Veterans Bank is owned by some 300,000 Filipino World War II veterans and their designated heirs. As part of its mandate, it is committed to provide 20% of its annual net income to the Board of Trustees of the Veterans of World War II, which in turn manages programs for the benefit of the veterans, their widows, orphans and heirs.

Roach wants out of Pacman-Floyd talks
