The Sarawak Ordinance co-e ists with the EQA, each oerating within its own shere ased on the constitutional authority of the State of Sarawak to regulate y legislation those comonents of the environment that fall within its domain. The udge concluded that µ[in% my judgment, Parliament, when it assed the EQA, did not intend, and could not have intended, to regulate so much of the environment as falls within the legislative jurisdiction of Sarawak.¶ (Court of Aeal udgment). He agreed with the su mission of the Senior Counsel that the Amendment Order was made µnot for the urose of cutting the ground from under the feet of the resondents as suggested y their Counsel, ut for the urose of making it a undantly clear to all concerned that the  order was not, for constitutional reasons, meant to aly to Sarawak.
