Florida Parental Relocation Divorce is a difficult and trying ordeal. There are many factors that must be considered when working through the terms of a divorce. These factors become even more complicated when children are involved. Having children means that former spouses must continue to have contact and work together for the child or children¶s best interests, being both a physical and financial presence. Time-sharing and other parental rights are difficult subjects to work out in a way that makes everyone happy. The time-sharing conditions are often dependent upon the former spouses staying in the same, or close to the same, geographical location. If this is the case, the arrangements can be negotiated relatively easily. Unfortunately this does always happen. Due to any number of personal or financial circumstances, one parent may have to relocate. Relocation necessitates a reworking of the original agreement in order to make sure that all custodial family members get equal say and full use of their rights in such a trying situation. Relocation Agreements Relocation agreements must be focused on the well being of the child or children. To do this, the state of Florida has enacted a relocation statute. There are specific procedures which must be followed when a parent plans to move more a significant distance away. This allows two possible solutions to this issue: y This first solution is a relocation agreement. In the case of a relocation agreement, both parents, and any other parties with time-sharing rights, come to an agreement about how to modify the original time-sharing contract.

Once all the details are worked out and agreed upon, a new written contract is then filed with the courts and takes the place of the original agreement. y The second solution offered is the notice of intent to relocate. This is the method used when the parents cannot come to any mutual decisions. If this is the case, the parent who is planning to move more than 50 miles away must file an ³intent to relocate´ with the courts.

If one of the entitled parties objects to the terms of the ³intent to relocate,´ a hearing may be held to come to a decision. During this hearing, the courts will weigh all factors involved before drawing a conclusion. Tips for Those Going Through the Relocation Process

This can be a very difficult and stressful time, especially if the parties involved cannot come to an agreement easily. All of those involved should have the right to live their lives as they wish while also maintaining the best interests of the child or children.
