Mayor Robb: Our client, Timothy Stevens, has indicated that to date you have failed to respond to formal public records requests in a timely manner. Specifically, our client filed a public records request on June 17, 2012 regarding all emails relating to city business, regardless of originating account, from the beginning of June through the date of the request. As the custodian for these records which stem largely from personal email account(s), it is your responsibility to fulfill this request in a timely basis. The Florida Supreme Court has stated that the only delay in producing records permitted under Ch. 119, F.S., "is the limited reasonable time allowed the custodian to retrieve the record and delete those portions of the record the custodian asserts are exempt." Tribune Company v. Cannella, 458 So. 2d 1075, 1078 (Fla. 1984), appeal dismissed sub nom., DePerte v. Tribune Company, 105 S.Ct. 2315 (1985). It is our position that the limited reasonable time allowable has long expired.
