 The Clayton Town Town Board is now in the fnal fnal process o modiying modiying the zoning on the north side o route 12 12 and route 12 E. They are changing changing many parcels rom rom arine Residential Residential to arine !e"elopment !e"elopment in the name o #economic #economic de"elopment$. de"elopment$. % am opposed to any a ny reduction in arine Residential. Residential. %&m urther opposed to any increase in zoning laws that encourage more more 'usiness along the scenic corridor. corridor. ore tra(c congestion and noise is not what Clayton is all a'out.  The process is mo"ing mo"ing ar too )uic*ly and as is a Clayton tradition+ "oting "oting is always done at a time when it&s di(cult or summer property owners to attend such meetings. Changes o this magnitude should not 'e rushed through. through. ,i- or se"en se"en months o discussion is simply not enough time. hen downtown Clayton Clayton was rezoned it was more than a two/year process. There were more than 20 meetings utilizing wor*groups. %nput was solicited rom as many people as possi'le+ and the results were were amazing. % 'elie"e that the town&s desire desire to hastily ma*e ma*e the zoning change is going to open Pandora&s 'o-.  couple o e-amples %n the new arine !e"elopment area they are adding arm wineries and arm distilleries as permitted use. t the town meeting they supplied a defnition o arm winery 3distillery that they say+ comes directly directly rom the state. state. There is no such defnition4 defnition4 there is a defnition defnition or arm wineries and there is a separate and di5erent defnition or arm distilleries. 6arm 6arm 'reweries 'reweries were let out. as it intentionally let out 'ecause we ha"e too many 'reweries7 'reweries7 as as it let out inad"ertently7 Either way it&s a pro'lem and a result o mo"ing too ast. Recently it was reported in the T.%. ,un at a 'oard meeting a property owner re)uested that the proposed law change wait until the summer property owners owners had a chance to study it. 8e was told in that the meeting+ meeting+ 'y the Town Town ,uper"isor that the town 'usiness cannot wait till summer property property owners return. e e must fnd a way to include as many property owners as possi'le in ma9or decisions that a5ect so many people. The town ollows state law regarding regarding notice to property property owners+ 'y ad"ertising in the local newspaper. newspaper. % thin* 'ecause o our uni)ue mi- o out/o/town and in town property owners it would 'e prudent to loo* at changing our law in the uture regarding regarding proper notice. The town has "ery little di(culty in locating all property owners when it comes time to collecting ta-es. % ha"e 'een personally criticized 'y se"eral 'oard mem'ers that the reason % oppose this pro9ect is 'ecause 'ecause % want to limit my competition. competition. They are using this this argument to marginalize marginalize my my comments. % am a strong strong supporter o entrepreneurialism. entrepreneurialism. % 'elie"e in the merican merican dream. % 'elie"e e"ery 'usiness owner should ha"e the right to succeed or ail. :et me 'e perectly clear % am a huge supporter o any arm/'ased 'usiness 'usiness in our area+ including all crat crat 'e"erages. % ha"e no delusions o 'eing the only winery winery in the Clayton area. area. 'usiness owners would preer not to ha"e more competition in their immediate mar*etplace. % guess %&m no e-ception. 8owe"er % cannot ignore my "ision o "ines growing throughout Clayton countryside. % am not thrilled with more competition 'ut % thin* Phil !e:u*e should ha"e the opportunity to open a winery. But )uite ran*ly+ the proposed winery that Phil !e:u*e wants to put in can 'e appro"ed without a massi"e zoning change. The Proposed !istillery on the sight o the 6ormer <unnery could 'e handled with a special use permit 9ust li*e they did or the pre"ious restaurant 'usiness. =nless it was illegal then and thereore is illegal now. The Downtown Afect . The a"aila'ility o more commercial property outside o the downtown Clayton will in9ure the downtown 'usiness owners. % ha"e 'een told that downtown is ull+ thereore we need more commercial property out side o the "illage. E"en though !owntown properties are rented+ there has still 'een much turno"er o"er the last couple o years. Because downtown is ull does not mean the stores are profta'le. ,till many downtown stores are seasonal and supported with other amily income. There is only a ew months where 'usiness owners can 'e profta'le in Clayton. The season is "ery short we need to gi"e the "illage 'usinesses a chance to succeed. %n the past Businesses that mo"ed out o the >illage downtown hu'+ or ha"e 'een relocated+ ha"e created a negati"e impact on the downtown 'usinesses4 %&d li*e to cite two e-amples 1. hen the grocery store was closed and the 'usiness consolidated out o the "illage. 2. hen ?enny&s drugstore mo"ed out on Route 12. Both o these mo"es had a huge fnancial impact on downtown stores. People used to shop by boat + 'uy their groceries+ "isit other downtown stores and they shopped locally. :[email protected] wor* on 'uilding what we ha"e instead o e-panding geographically. :[email protected] not ma*e our !owntown 'usinesses su5er more in the name o economic de"elopment. Marine Residential is the Crown Jewel o Clayton and is what most people that come here+ come here or. Peace and )uite ree rom noise pollution. The proposed law does not address the noise issue at all. The Change rom arine Residential AR to arine !e"elopment A! will open more area to 'usiness e-pansion and create more tra(c and congestion. hat ne-t+ more stop lights7 :[email protected] lea"e The arine Residential property zoning alone. t the last town 'oard meeting there was tal* a'out may'e ha"ing a noise ordinance+ %n the arine Residential area soon to 'e con"erted to arine !e"elopment+ the use o deci'el meters to measure sound was mentioned.
