Peter St. Dela Costa Homes, Barangka, Marikina City after first being duly sworn is
accordance with the law, hereby depose and state:

1. I am the complainant in the instant complaint entitled Jesus G. Gabito Jr.,
vs. Bright Maritime Corporation, NLRC Rab. No. NCR Case No. (M) NCR-
04-04946-14 for payment disability benefits, damages due to fraud with the
prayer for the award of actual, moral and exemplary damages, as well as
attorney’s fees, submitted to the jurisdiction of the National Labor and
Relations Commission to be decided by arbiter ERIC V. CHUANICO.

2. I have caused the preparation and filling of the foregoing Position Paper, and
have read the same and attest that the allegations therein contained are true
and correct based on my own personal knowledge and/or authentic records.

3. I further certify that:

a. I have not commenced any other action or proceeding involving the same
issues raised in this Position Paper in the Supreme Court, the Court of
Appeals or any Division thereof, or any tribunal or agency; and

b. I am not of any other action or proceeding involving the same issues in the
Supreme Court, the Court of Appeals, or any Division thereof, or any
tribunal or agency; and

c. If I should learn that a similar action or proceeding has been filed or is
