Tax Relief Act of 2010
Overview of Key Tax Provisions of The Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010 (HR 4853) The Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010 (referred to as "the Tax Relief Act of 2010" or "the Act"), was passed by Congress December 16, 2010. The President signed the Act into law on December 17, 2010. The Act generally consists of extensions of expired or expiring tax provisions. One of the most important features is the extension of the Bushera tax cuts set to expire December 31, 2010. Also included in the bill is the extension of several popular tax breaks and the AMT "patch" - all of which expired December 31, 2009. Below is a summary of these provisions. Provisions of the tax relief act of 2010 Individuals 1. AMT Patch 2. Traditional "Small" Extenders 3. Payroll Tax Holiday 4. Mortgage Insurance Premiums 5. Nonbusiness energy Property Credit 6. Tax Rates 7. Limitations on Itemized Deductions and Personal Exemptions 8. Marriage Penalty Relief 9. American Opportunity Credit and Other education Benefits 10. Child Tax Credit 11. Earned Income Tax Credit Small Businesses 12. Traditional Extenders 13. Bonus Depreciation 14. Payroll Tax Holiday 15. Section 179 Deduction Estate and Generation Skipping Transfer Taxes 16. Estate Taxes 17. Generation Skipping Transfer Taxes

What Expires 18. Increased Standard Deduction for Real Property Taxes 19. New Vehicle Sales Tax Deduction 20. First $2,400 Unemployment compensation Exclusion 21. Required Minimum Distribution Waiver 22. Making Work Pay Credit 23. Alternative Motor Vehicle Credit Explanation of these provisions: Effective for tax years 2010 and 2011 1. AMT Patch. • The Act extends higher AMT exemptions amounts for 2010 ($47, 450 for S and HH filers, $72,450 for MFJ filers) and 2011 ($48,450 for S and HH filers, $74,450 for MFJ filers.) (Higher AMT exemptions result in fewer taxpayers paying AMT. •The patch extension also allows certain nonrefundable personal tax credits for AMT. These include the dependent care credit, the nonbusiness energy property credit, and the lifetime learning credit. 2. Traditional "Small" Extenders. •Tuition and fees deduction •State and local sales tax deduction •Educator's expense deduction •Qualified charitable distributions from IRAs •DC Homebuyer Credit Effective for tax year 2011 only 3. Payroll Tax Holiday. New! Establishes a "payroll tax holiday"- a reduction in the employee-only-portion social security tax. •The employee only portion of social security tax, 6.2% of the first $106,800 in 2010, is reduced to 4.2% of the first $106,800 in 2011. the maximum dollar reduction in social security taxes is $2,136. This reduction applies only to the employee portion of social security. Note: This is a payroll, not income, tax provision and has

no effect on tax withholding or estimated tax payments, which are related to income tax liabilities. •The SE tax rate for selfemployed taxpayers will also be reduced from 12.4% to 10.4%. Note: Because SE taxes are paid together with federal income taxes, this reduction may affect estimated tax payments as well as the taxpayer's total tax liability. 4. Mortgage Insurance Premiums. Mortgage insurance premiums paid by a taxpayer on a qualified mortgage may be deducted as mortgage interest, subject to phaseout on the taxpayer's AGI. This provision was set to expire after 2010. 5. Nonbusiness energy property credit. The Act extends for one year the credit for energysaving home improvements, such as windows, insulation, and furnaces. However, preARRA limitations apply, including the $200 limit on windows and $500 overall credit limitation. Effective for tax years 2011 and 2012 only 6. Tax Rates. •Individual tax rates. Lower rates in effect for 2010 are extended through 2012. Tax rates established by EGTRRA and JGTRRA (10%, 15%, 25%, 28%, 33%, and 35%) are extended through 2012. Current (2010) rates on long-term capital gain and qualified dividens are extended an 2 for all taxpayers regardless of income. •Capital Gain and Qualified Dividend Rates. Favorable capital gain and qualified dividend rates in effect for 2010 are extended through 2012. Current (2010) rates on long-term capital gain and qualified dividens are extended an additional two years. The maximum net log-term capital gain rate remains at 15% (0% for taxpayers in the 10% and 15% tax brackets). Qualified dividends continue to be taxed at favorable capital gain rates instead of at ordinary income rates. 7. Limitations on Itemized Deductions and Personal Exemptions. Completely repealed in 2010, itemized deduction limitations and personal exemption phaseouts for higher income taxpayers were scheduled to be reinstated after 2010. However, this Act repeals the itemized deduction and personal exemption phaseout for two more years. This means that taxpayers can claim their full itemized deduction and personal exemption amounts, regardless of income. 8. Marriage Penalty Relief. Extended for two years, this provision helps married taxpayers filing joint returns avoid paying higher taxes than they would pay if they were single filers. 9. American Opportunity Credit and Other Education Benefits. •American Opportunity Credit (AOC). The AOC is an enhanced Hope credit introduced by ARRA in 2009 and set to expire December 31, 2010. The AOC is a partly-refundable credit up to

$2,500 for the firt-four years of college. •Coverdell Education Savings Account. A taxfavored savings vehicle for education expenses. The Act maintains the $2,000 contribution limit, which was set to decrease to $500 in 2011, and allows tax-exempt distributions for qualified elementary and secondary education expenses. •Student loan interest deduction. An above-the-line deduction up to $2,500 of qualified interest. The Act continues EGTRRA enhancements which include repeal of the 60-month time period over which loan payments qualify for the deduction and higher phaseout ranges. These enhancements make the deduction available to more taxpayers. 10. Child Tax Credit (CTC). The maximum CTC per qualified child will remain at the 2010 level of $1,000. The enhanced ARRA provision allowing refundability of the credit for earned incomes over $3,000 has been extended as well. 11. Earned Income Tax Credit (EITC). •Continues the way that the credit was calculated under EGTRRA. •Extends the higher phaseout range ($5,000 adjusted for inflation) for married taxpayers filing a joint return. •Extends higher EITC for families with three children. Business Provisions Effective for calendar year 2010 and 2011 12. Traditional Extenders. The Act extends several business incentives that expired December 31, 2009 for two years through 2011. These include: •The research and development credit •Indian employment tax credit •The Work Opportunity Tax Credit •Employer wage credit for employees who are in the military on active duty Effective September 9, 2010 through December 31, 2012 13. Bonus Depreciation. •The Act allows 100% expensing of qualifying property placed in service September 9, 2010 through December 31, 2011. •For 2012 only, 50% bonus depreciation is allowed. Effective for calendar year 2011 only 14. Payroll Tax Holiday. NEW! Establishes a "payroll tax holiday" - a reduction in the employee-only portion of social security tax. •The employee portion only of social security tax, 6.2% of the first $106,800 in 2010, would be reduced to 4.2% of the first $106,800 in 2011. The maximum dollar reduction in social security taxes is $2,136. This reduction applies only to the employee portion of social security. Section 179 Deduction. Effective for 2012 only, the section 179 limitation for qualified property is $125,000 with a phaseout threshold of $500,000. This is a decrease from the 2010 and 2011 limitation of $500,000. However, absent the Act, the limit and threshold would have been significantly lower ($25,000 and $200,000, respectively) Estate and GST Taxes 16. Estate Tax. • The estate tax, which was repealed in 2010, has been

reinstated. The maximum estate tax rate is 35% with an exemption of $5 million that is indexed to inflation. The Act also reestablishes stepped-up basis on property inherited from a decedent. •Executors of estates of decedents who died in 2010 may elect to apply the previous provisions (no estate tax, modified carry-over basis). 17. Generation Skipping Transfer Tax. The generation skipping transfer tax is reinstated for 2010 as well and generally conforms to the estate tax provisions. However, for 2010, the GSTT rate is 0%. What Expires Beginning in 2010, the following provisions are not available: 18. Increased Standard Deduction for Real Property Tax 19. New Vehicle Sales Tax Deduction 20. First $2,400 Unemployment Compensation Exclusion 21. Required Minimum Distribution Waiver Beginning in 2011, the following provisions are not available 22. Making Work Pay Credit 23. Yet many people are not aware of the positive effects that a healthy, balanced diet can have on their eyes. A recent study in the United Kingdom by Transitions Optical revealed that 43 percent of consumers were unaware that improper nutrition can cause damage to the eyes and even contribute to conditions such as cataracts and age-related macular degeneration. “Good nutrition and a proper, balanced diet are important in any aspect of personal health,” said Dr. Vincent Young, ophthalmologist. “When I talk to my patients about diet, I stress the importance of balance. When recommending specific foods, leafy green vegetables, such as kale and collard greens, are great components of a diet that promotes healthy sight.” What’s more, 93 percent of the study’s respondents considered sight to be their most valuable sense and the one they feared losing the most, yet most showed a lack of knowledge about foods that contribute to healthy eyesight. According to Dr. Young, other foods that benefit the eyes include fruits, such as grapes and berries, vegetables, especially carrots and squash, soy, nuts and wine, in moderation. These foods contain vitamins A, C and E as well as fatty acids and omega3, all of which contribute to eye health. Dr. Young also stresses the importance of maintaining a healthy diet when managing diabetes, since diabetes often causes vision-threatening complications, such as diabetic retinopathy and, in some cases, even blindness. For diabetic patients, diets low in sodium and rich in antioxidants are good. While a balanced diet promotes healthy vision from the inside, it’s also important to protect your eyes from the outside. Dr. Young recommends the following steps to protect and promote healthy sight for the entire family: • Schedule regular visits to your eye doctor • Wear sunscreen and UVprotective clothing • Consider adaptive eyeglass lenses, such as Transitions lenses, that automatically adjust the level of darkness to block 100 percent of UV rays and help to reduce distracting glare • Drink plenty of water daily and maintain a balanced diet high in beta-carotene and antioxidants

By Tresa Erickson Water is vital to life. Without it, very little can survive, including the human body. Obviously, you need to consume enough water to keep your body functioning well, but how much is enough? Eight glasses of water daily, right? Wrong. Although that may be the magic number for many people, including some doctors, there is no scientific evidence to support the fact that the body needs eight glasses of water per day. Water intake should be based on lifestyle. Here are some more myths surrounding the component vital to life. More water, fewer toxins While some scientific studies show that water aids the release of toxins from the body, some don’t. Drinking more water does not necessarily improve the function of the bladder and kidneys and speed up the excretion of toxins. What it does do is dilute the toxins and make them easier to excrete. More water, better organ function Water is vital for organ function. No organ can function properly without the right amount of water for very long. Consuming more than the amount of water needed, however, will not improve organ function. The organs will use only what they need and the rest will be excreted. More water, lower weight While it’s true that drinking water might make a person feel fuller and eat less at the time, that doesn’t mean the person won’t feel hungry later and eat then. Drinking water to eat less does not necessarily translate into weight loss. The calories reduced by water intake might very well be made up later, reducing the chance of weight loss. More water, better skin tone The skin needs water, just like every other organ in the body. Drinking more water, however, does not guarantee great skin, as very little of the water consumed ends up in the skin. There are no scientific studies to prove a direct correlation between increased water intake and improved skin tone. More water, fewer headaches While drinking water will

prevent dehydration, which can cause headaches, drinking more of it will not ward off headaches indefinitely. Headaches can arise from a number of conditions, from tension to health problems, few of which have anything to do with the consumption of water. There is very little scientific evidence touting the benefits of increased water intake. Rather than push yourself to drink the magic eight, why not just drink the recommended amount for your lifestyle and stay hydrated and feeling good? * * *

What A Bother
By Tresa Erickson Warts are caused by a form of the human papillomavirus (HPV), which most commonly enters the body through breaks in the skin. They can develop on almost any part of the body, including the bottoms of the feet. Warts that occur on the bottoms of the feet are known as plantar warts. They vary in shape and size, ranging from small bumps resembling corns to flat growths resembling calluses. They also vary in color from brown to gray. The form of HPV that causes plantar warts thrives in warm, wet environments like showers and locker rooms. That is why it is important to wear shoes in public showers and locker rooms. People react differently to the virus, so not everyone who comes into contact with it will develop plantar warts. Those with cuts in their skin, a weak immune system or multiple exposures to the virus are most at risk. Plantar warts are not considered serious. However, they can swell and spread, leading to clusters, which can make walking and running difficult. Treatment is recommended and comes in various forms. Over-thecounter medications typically contain salicylic acid, which will eat away the infected skin gradually. Duct tape is another at-home remedy. When applied over plantar warts for an ample amount of time, it will irritate them, motivating the body’s immune system to attack them. Freezing is another common treatment used by physicians.

Hearing loss affects different people, differently. Over time, hearing loss can lead to anxiety, depression, isolation, loneliness and even anger. Fingernails: An Indication Of Your Health?
By Tresa Erickson Take a look at your fingernails. How would you describe them? Are they long and beautiful? Short and stubby? Beyond that, what kind of condition are they in? The answer to that question may provide clues to your physical state. Fingernails consist of many parts. The cuticle or eponychium lies at the bottom of the nail and meets the perionychium, the tissue that runs up the sides of the nail. The actual nail is called the nail plate. Hard and translucent, it protects the nail bed, or the connective tissue underneath. Within the nail bed is the whitish half-moon area called the lunula. The free or distal edge is the part of the nail that extends past the actual finger. Of these parts, the nail plate and bed are perhaps the most telling. The state of these can point to the presence of a health problem. Fingernails vary in appearance from person to person. Healthy nail plates are generally thick, round and smooth. Nail plates that do not fit this description may indicate a health problem. Here is a brief list of nail plate conditions and the health problems sometimes associated with them: • Dry, cracked, brittle nailscalcium or fatty acids deficiency • Flat, thin nails-vitamin deficiency • Hangnails-folic acid or vitamin C deficiency • Raised nails or nails that curl under-respiratory problems • Square, wide nailshormonal disorders • Horizontal ridges in nailsphysical or mental stress • Vertical ridges in nailsiron deficiency, kidney problems or poor nutrient absorption Color can also be an indication that something is not

quite right. Healthy nail beds should be rosy pink or peach. The presence of any other colors may indicate a health problem. Here is a brief list of nail bed colors and the health problems sometimes associated with them: • Pale nail beds-anemia • Half-white, half-pink nail beds-kidney problems • Blue nail beds-lung problems • Dark blue lines in the nail beds-skin cancer • Tiny black streaks in the nail beds-melanoma • Green nail beds-infection • Reddish-brown nail bedsfolic acid, protein or vitamin C deficiency • Irregular red lines at the base of the nail beds-lupus • White nail beds-liver problems • White spots in the nail beds-iron or zinc deficiency • White-lined bands in the nail beds-protein deficiency • White lines in or across the nail beds-fever, heart disease, iron or zinc deficiency, or kidney or liver problems • Yellow nail beds-liver or lung problems • Yellow nail beds tinged with blue-diabetes Nail plate condition and nail bed color may point to the presence of a particular health problem but are by no means a sure indication. If you are taking more or less at times other than what is recommended, you need to reveal that information. Yes, you might be scolded, but better to experience that than a serious medical interaction or take an unnecessary prescription. • Do you work out regularly and eat properly? Total honesty is required, even if it means you must admit you rarely work out and consume a lot of fat, sugar and salt. Doing so will give your doctor a more accurate picture of your lifestyle and help them make an accurate diagnosis. • Do you smoke or drink, and how much? Again, it is essential you answer these questions truthfully so your doctor can prescribe the right treatment. Some medications can be lethal when combined with alcohol or the adverse effects of smoking. • How do you feel? If you feel lousy, say so and be specific about your symptoms, whether physical or mental. Don’t keep mum about your stress or anxiety. When it comes to doctor’s visits, honesty is always the best policy. Resist the urge to keep things to yourself or make things out to be better than they are. Tell it like it is and give your doctor the goods to make an accurate diagnosis and prescribe the proper treatment.

second spring gobbler tag at any issuing agent and walk out of the store with the license in hand, or they can purchase it online and wait for it to be mailed to them within 10 days.” Roe noted that all general hunting license holders are able to take one spring gobbler as part of their general hunting privileges; the second spring gobbler tag license affords those hunters interested in this additional opportunity to take a second spring gobbler. Hunters may only purchase one second spring gobbler license during a license year, as the season limit remains two spring gobblers, and the daily harvest is one bird per day. “So, if you are looking for that application in your digest or online to mail in, you won’t find it,” Roe said. “You can just purchase the special spring gobbler license either through the Game Commission’s website or visit your local license issuing agent.” Fees set by state law for the special license are $21.70 for residents and $41.70 for nonresidents. For online orders, there are additional shipping and handling costs. The 2011 spring gobbler season is set to run from April 30May 31. The Board of Game Commissioners approved a change to the legal hunting hours. Under the change, legal hunting hours from the opening day of the spring gobbler season through the third Saturday (April 30-May 14) will retain the long-standing one-half hour before sunrise until noon timeframe. However, the remainder of the season (May 16-31) will be expanded to run all day, from one-half hour before sunrise until one-half hour after sunset. Roe noted that the Board also extended the traditional closing day of the spring season to May 31. This additional recreational hunting is provided with minimal impact to the resource because disturbance of hens would be less since most hens would be in the later stages of nest incubation when they are less prone to abandon the nest. The one-day Spring Gobbler Youth Hunt will be held on April 23, and will run from one-half hour before sunrise until noon. fb

22ND ANNUAL SKILLSUSA-REGION I LEADERSHIP CONFERENCE AND SKILLS OLYMPICS Wellsville, NY, February 2011- Alfred State College will host the upcoming 22nd annual SkillsUSA-Region I Leadership Conference and Skills Olympics, (formerly VICA-Vocational Industrial Clubs of America) Tuesday, March 8, from 8 a.m. until 4 p.m. Nearly 1,000 BOCES students, their advisers, observers, parents, and guests from Western New York counties,

including Allegany, Steuben, Monroe, Erie, Niagara, Orleans, Cattaraugus, and Ontario, will converge on the Alfred State College (462 student competitors) campus and the ASC School of Applied Technology (271 student competitors) campus, Wellsville, where they will compete in their areas of study. Competition areas range from extemporaneous speaking and graphic communications to heating and air conditioning to law enforcement and ground maintenance to auto service, collision repair, and brick masonry, to cake decorating and small animal care (vet assistant). Alfred State College faculty, staff, and students will assist in judging the competitions. SkillsUSA participants will have an opportunity during the day to view dorm life and eat lunch in the campus dining hall. An awards ceremony completes the day. Brubaker, an assistant professor in the Electrician and Computer and Robotics Technician Department where he teaches magnetic motor controls and programmable logic controllers to senior students, is currently serving as interim director of Facilities Services at the college. Prior to joining the Alfred State College faculty, Brubaker served as senior electrical specialist at West Valley Nuclear Services, Co. Brubaker holds a bachelor of professional studies degreebusiness degree-from Empire State College and an associate of occupational studies degree from Alfred State College.
