Re:

Rambus Northern District of California Cases

Dear Ted:

nit

I am writing in response to your letter of June 5 2007 regarding representative p parts. arts. Let respond to your paragraphs in order:

First. nly letter of May 3 1 2007, was intended intended to be a response to Hynix's H ynix's representati representative ve parts proposal As I indicated there, subject to working out details, we can likely agree on Hynix's proposed DDR2 part as being representative of Hynix's accused DDR2, Graphics DDR: and GDDR3 parts. While you had proposed a separate separa te representative represe ntative GDDR3 GDD R3 part, you indicated that once Rambus had identified its 25 claims. you could determine whether, in Hynix'ss view, a single representativ Hynix' represe ntativee part would suffice. Since Rambus did identify its 25 claims a week week ago. there should be no impediment impediment to your letting us know Hynix's views on this. Seconcl. the caveat in my May 3 1 letter "subject to agreement as to precisely what

[agreeing on a representative part] will mean" simply meant that we had yet to agree on the exact language of a stipulation. Presumably, language Presumably, such a stipulation would provide that a determination of

Theodore G . Brown, 111 June 7, 2007 Page 2 infringement or noninfringement of the representative part would bind the parties as to all other Hynix parts for purposes of the '334 c ase . Likely, Hynix will want the agreem ent to pr provide ovide that Hynix would need to produce complete schematics only only for its representative representative part. I am confiden t that we will be able to agree on precise languag e for a stipulation along these lines. Third, as previously previously no ted, Rambus would like the manufacturers to propose a single part as representat representative ive of their DDR 2, Graphics DDR2 and GDD R3 parts or, if they are unable to do so, explain the differences am ong the parts that, in the manufac turers' view, preclude such a proposal. Judge Whyte has ordered the man ufacturers to do this. See Tr . (5124107) at 9 (indicating that the manufacture rs should disclose to Ram bus their basic thoughts on what makes a difference as to representative representative products products so that hopefully we c an avoid a problem problem ). Judge Whyte also indicated that if the manufacture rs ultimately propose a num ber of products that they think are involved, I will be willing to reconsider the identification of claims. Id O f course. Rambus d oes not intend Hynix to develop such a pr proposal oposal alone, but, rather, as you suggest to to confer with the the other manufac turers and make a joint proposal. We expec t that that the manufacturers should be able to designate a single representativ e part or explain why not no later than Thursda y, June 14 (at which point they will have had Ra mb us's list of 25 claims for two weeks). Please let me know

i

you have any questions or would like to discuss these issues.
