IV. FACTS 8. Buckley owns and controls the land and structureson the properties located at 1803 and

1809 Rock Island Street (the "Buckley Properties"). Rosebudowns the property located at 1811 Rock Island Street where Buckley operates its business(the "Rosebud Property") (collectively the "Properties"). 9. The City's fire marshal has determined that various existing structures, facilities, and

conditions on the Properties constitute distinct hazards to life and property. Specifically, the following violations of the Dallas Fire Code exist and/or have existed at the Buckley Property including but not limited to: 1. Failure to provide and maintain approved required transfer and process transfer operationsin violation of Section 3406.5.t through 3406.5.4.4. Failure to separatetank vehicles and tank car transfer facilities by a distance of 25 feet for Class I liquids and 15 feet for Class II and III liquids from buildings, aboveground storage tanks, combustible materials, property lines, public streets, public alleys or public ways in violation of Section3406.5.1.1.

testing of tanks prior to being placed into service in Failure to demonstrateacceptance violation of Section3404.2.12.2. Failure to demonstrate tanks have been placed into service with testing done in accordancewith Section4.4 of NFPA 30 and in violation of Section 3404.2.12.2. Failure to demonstrate that piping has been pneumatically tested at lt}Vo of the maximum anticipated pressue or hydrostatically tested at t50%o of the maximum anticipated pressure and that all piping, valves, fittings, and ancillary equipment for use with flammable or combustible liquids have been tested in violation of Section 3403.6.2, Section 2206.6, and NFPA 30. Failure to provide an emergency disconnect switch for external fuel dispensing operations within 100 feet of, but not less than 20 feet from, the fuel dispensingarea in violation of Section 2203.2.

Additionally, the following violations of the Dallas Fire Code exist and/or have existed at the RosebudProperty including but not limited to: 36. Failure to provide adequate fire department access roads and/or fire hydrant availability in violation of Chapter 5, Section 3403.2.2.,and Section 3504.2.2. Copies of the ordinancesthat Buckley and Rosebudhave violated are attached. 10. These ordinancesrelate to: a. The preservation of public safety, relating to the material or methods used to construct a building or other structure or improvement, including the foundation, structural elements, electrical wiring or apparatus,plumbing fixtures, entrances,or exits (Tex. Loc. Gov't Code $ 54.012(1)), and b. the preservation of public health or to the fire safety of a building or other strucflre or improvement(Tex. [-oc. Gov't Code $ 54.012(2). 11. Personsother than Buckley and Rosebud and property other than that of the Buckley and

unless Buckley and Rosebud comply with these ordinances. Among other risks, there are many storagetanks containing flammable and combustible liquids that are too close to each other. If certain types of accidents occurred on the Property, the vast majority of the tanks could explode and thereafter burn for many days. Such an event risks significant damage to the Property and nearby properties, loss of life, air pollution, and contamination of the Trinity River. V. CAUSE OF ACTION 12. Subchapter B of Chapter 54 of the Texas Local Government Code applies to these

ordinances. 13. Pursuant to Sections 54.0L6 and 54.018 of the Texas Local Government Code, the City

requeststemporary and permanent injunctive relief, ordering Buckley and Rosebud to remedy or repair the conditions of the Property to bring it into compliance with the Dallas City Code. 14. Pursuant to Section 54.017 of the Texas Local Govemment Code, the City requestscivil

penaltiesnot to exceed$1,000 per day for each violation of the ordinances. VII. PRAYER WHEREFORE, PREMISES CONSIDERED, the City, prays rhat court: 1) Grant the City temporary and permanentinjunctive relief as requestedherein; 2) Award the City with a judgment for civil penalties not to exceed $1,000 per day for each violation on the Property; 3) Grant the City a judgment for all costs of court; 4) Grant the City a judgment for post-judgment interest at the highest legal rate; and 5) Grant such other and further relief, both general or special, at law or in equity, to which the City may be justly entitled.
