As 2010 ends and 2011 begins, it's tempting to make resolutions for the New Year. Organize your office? Increase your billable hours? Lose weight? Be on time for work? Sit for a certification exam? Whatever you have in mind, read on... It's common knowledge that resolutions rarely work. All those good intentions seem to fall by the wayside by the middle of January...all that's left are guilt and regret that once again you're not able to keep your resolutions. By next December you'll be making the same resolutions all over again. It's time to change the pattern. Resolutions don't work because they're usually a very broad statement: This year I'll lose 20 pounds. This year I'll learn to speak French. This year I'll look for a new job. You've got the want down...you know what you want to do. The problem is, you're only looking at the big picture. Instead of making resolutions, set goals. A goal is something you commit to fully and work toward all year long. Take a few minutes right now to visualize your top three goals for 2011. Then take out a piece of paper and write those goals down. Make a plan. Once your goals are set, decide what you have to do to reach each goal and then plan each step toward your goal from beginning to end. For instance, if you want to learn French this year your first step might to be to search for a class. The next step might be to enroll in the class. The next step might be to buy your study materials. Your next steps would be to attend each class and do your homework. Do you see how each step you take helps you reach your end goal? This process will work for any goal you might want to reach. Take this one st ep further. Schedule each step in your planner...make an actual appointment. This ensures you will set aside the time to accomplish each step. Don't make the mistake of putting the steps on 'to do' lists because a 'to do' list is just a wish list and you will invariably run out of day before you run out of list. The 'to do' list just goes on and on. Your planner is a real guide for accomplishing your goals. Your challenge: Plan to make 2011 your best year ever. Take a few minutes to set your goals. Break the goals down into achievable mini-goals. Decide when each mini-goal must be accomplished to reach the main goal by the end of the year. Enter those mini-goals in your planner. Make appointments with yourself for completing each one. If you do your planning and then do your scheduling, you can accomplish absolutely anything you want and this time next year you'll be celebrating the fact that you actually reached your goals. Here's to out with the old...in with the new...to a new year and a fresh start. Happy New Year!

SIMPLE WORDS BY: Caren Mansfield, a member of the Illinois Paralegal Association The undersigned, the fabulous writer of this instrument, henceforth and herewith, and pursuant to our agreement on the occasion of the recent date certain replies to your respectful request and prayer for information. This means - I agreed to write. One of the problems, I mean longstanding traditions in the legal field, has been the use of language that may seem formal, verbose, stilted, inflated or simply not understandable. A paralegal can learn to remain professional and retain formality while creating documents that are clear, concise and informative. The trend in the legal profession over the past several years has been to simplify terminology, to avoid using legal jargon when more simple terms will suffice and even use plain language. The courts ask for clear and concise language in pleadings. The use of words containing several syllables does not necessarily mean that you are getting your point across. Part of developing a career as a paralegal is creating or defining your writing style. Part of defining your writing style may be adapting to the writing style of the lawyers who employ you. Every writer has quirks or terms, phrases or words that are used frequently. Those certain, favorite terms may appear frequently in documents to lead the reader along. When reading documents do those terms overwhelm you? Part of developing a writing style is to identify when such terms are overused. Does your favorite attorney use the term “irregardless” or other such terms. No, irregardless (and others like it) is not a word and it will be your responsibility to gently wean him or her from using words that will simply make opposing counsel or a judge scratch their head in wonder at the ingenuity of the word. A paralegal should consider who the reader of the document will be. Will your document be read by a client, your employer, the court, a vendor, etc. Another consideration is the organization of the document. When drafting documents for the court, please review the local rules to determine if the court has preferences for the document. The federal courts are very specific about what information is to be included in briefs, how it should be organized and the page length. Organizing the document with your important ideas in the beginning and ending on a strong note may be effective communication. Or beginning the document with background information and leading up to the point may be preferred. Will your document be persuasive or informative? What books are handy? Roget’s Thesaurus and a pocket dictionary. A paralegal may wish to invest in similar books to assist in refining writing skills. Both are handy when at a loss for an appropriate term or to check for correct terminology (you know, principal/principle, i n s u r e / e n s u r e , affect/effect, etc.). What else? Attend a writing class. Read to discover what works for other writers. So in keeping with the subject perhaps this article should be shorter than usual. You’ve got the point, right. Avoid being wordy. Stop using more words when less is better. Get rid of herewith, henceforce, hereafter, aforementioned, hereinafter. You get my drift. I would ask that one should have a multitude of frivolity when elucidating your thoughts — please have fun when you write! Experience required: • 5+ years of prior Docket experience, 2+ years of supervisory experience; • A thorough knowledge of court rules, procedures and industry products and services; • Knowledge of various court websites, docket searching and document retrieval databases (PACER/ECF Systems, electronic research, eDocket, Microsoft Windows). Additional requirements: • Must have the ability to work independently; • Must be available to work overtime and be on-call for electronic case filings; • Must possess strong written and verbal communication skills, and excellent time management and organizational skills; • Must possess thorough attention to detail.
