Lateral Lawyer Moves Were Brisk In 2010

Lateral partner moves created brisk business for legal recruiters in Chicago in 2010, according to three local recruiters - and
they say 2011 promises to be as good or even stronger.
Two recruiters said lateral associate recruiting is also making a comeback because law firms cut associates so heavily when the
Great Recession hit.
Interviewed for this story were Kay Hoppe, president of Credentia, Inc.; Alan J. Rubenstein, executive vice president of Chicago
Legal Search Ltd.; and John A. Cashman, partner in Major, Lindsey & Africa's Chicago office.
In the current economy, "this whole talent grab" has become crucial for law firms, Hoppe said, because competition is so stiff
among firms and the firms are operating on a thin margin of error.
In partner recruiting, "they've got to make a perfect business call on what areas they are going to focus on," Hoppe said, "and
then they've got to go get the best talent available, period, because you are in competition."
"So many more questions are being asked," she said. "Firms have trimmed down to the bone so that anything that is done now"
in partner recruiting "affects everybody."
Rubenstein predicted "2011 as a very busy, lateral year, perhaps approaching the record year of 2007" for recruiting of both
lateral partners and lateral associates.
"Business activity is clearly picking up at a healthy, if not yet torrid pace," Rubenstein said. He sees already increased lateral
hiring "across the corporate area and particularly in areas such as M&A, finance, securities and private equity. Second, capital is
beginning to flow more freely, driving more deal work."
"Most importantly, law firms cut associates at such a dramatic rate during the downturn" that law firms are now "competing for
top, lateral talent" in experienced associates, Rubenstein said.
Cashman gave a moderate view. He said "the ranks of associates at mid-level are pretty thin" in local law firms. Firms are
getting busier now and are recruiting lateral associates but "being selective, very selective," Cashman said.
Litigation and corporate work "are key areas for recruiting associates," Cashman said.
"The only thing that is not as robust as you might expect is intellectual property litigation. Historically, it just booms year in and
year out, but it seems a little slower."
Nevertheless, lateral partner recruiting was "better than it's ever been in 2010," Cashman said.
Cashman said "2011 will be a very strong year for lateral recruiting. Law firms are getting better at hiring lateral partners, and the
partners are more open to change than ever before."
"I foresee more demand. I don't foresee the return of the boom boom era," Cashman said. But "I think it will pick up quite a bit
during the year."
Rubenstein said "partner hiring didn't slow down during the recession the way associate hiring did."
And associate hiring started to show some life in the first half of 2010. "Then the second half of the year and particularly the last
quarter has been very busy," Rubenstein said.
The pickup in associate hiring is reflected in several ways, Rubenstein said.
Most of the high-quality, laid-off associates have now found new jobs, even if not as lucrative as their previous jobs. Law firms
that recruited on their own when associate talent was abundant have resumed using recruiters again, he said. And "firms are
struggling in certain searches to find capable people."
Plus, associates who are unhappy are once again willing to explore changing firms.
Hoppe predicted that the new trend in Chicago in 2011 will be law firms that strive to place themselves firmly in the second tier,
just below the elite firms, by offering and recruiting quality lawyers but providing services "at slightly more competitive rates."
The top firms are well established now in recent legal market segmentation, and she said, "there are elite firms that are
committed to elite work, and they are willing to sacrifice some of the lower rate work."
"I think there's a huge opportunity for one to four firms to come in right under the elite firms. … I think there's going to be a battle
for the next tier."
In 2011, Cashman predicted there will be "more exploration" of mergers involving Chicago law firms, like the big one in 2010
when Chicago's
Sonnenschein, Nath & Rosenthal merged with London-based Denton Wilde Sapte, creating SNR Denton.
