NALP leaves law school recruiting largely intact
By Jerry Crimmins Law Bulletin staff writer
The decision by the National Association for Law Firm Placement to suggest only modest changes in how law firms recruit from law schools means the process is still broken, David E. Van Zandt, dean of Northwestern University School of Law, said Monday. But a representative of the University of Illinois College of Law said NALP's decision to scale down its proposed reform of recruitment guidelines may be appropriate. "In my mind, what matters is that the end result we arrived at works for law firms and law students," said Tony Waller, assistant dean for career planning and professional development at U of I law. NALP announced Friday that after months of study, the timing guidelines for law student interviews, job offers and acceptance of offers "will remain largely unchanged" in 2010 with two exceptions. The principal change will be that law students who had not previously worked for an employer — and who get job offers — will now have 28 days to respond instead of 45 days. NALP chose to drop another, far-reaching proposal after a heated response from two law firms, Jones, Day and K&L Gates LLP. In January, NALP Commission on Recruiting in the Legal Profession recommending that although the interview process should remain in the fall, law firms should be restricted from making job offers until a single "kick-off day" in January. NALP's recruiting commission had also recommended that after the January kick-off day, law students be allowed only 14 days to accept or reject job offers. The proposed switch to making summer associate job offers in January was intended as a response to law firms that complained it was too difficult to determine their hiring needs two years before law students graduate. That plan got a harsh reception in February from Jones, Day's hiring partner, Gregory M. Shumaker. He said that NALP's attempt to tell law firms when they could make job offers was anti-competitive, probably illegal under antitrust laws, and tilted in favor of less stable law firms. Peter J. Kalis, chairman of K&L Gates, wrote that NALP "should be abolished." In its changes announced Friday, NALP also pulled back on the effort to mandate when law firms can make job offers to law students. NALP's standards issued Friday "are guidelines, not regulations," NALP said. In reaction to NALP's pullback of its revolutionary plan, Shumaker, of Jones, Day, told the Law Bulletin: "We believe NALP's announcement reflects a thoughtful response to concerns raised by a number of law firms." Kalis said Monday that he would have no comment. Van Zandt, of Northwestern, said he thought's NALP's proposal of postponing the timing of job offers until January "was a positive change." "But I'm not upset that it didn't work out," he added. NALP's intent, Van Zandt said, was to "stop the race" among law firms to be the first to do on-campus interviews. Law firms don't want to miss out on the best candidates, so they want to interview early and make job offers early — currently often in August to new, second-year law students, Van Zandt said. "Harvard got burned" in 2009 because it set on-campus interviews for October when most other law schools were allowing such interviews in August or September, the NU dean said. The result was "Harvard felt that by the time law firms came on campus, there weren't that many jobs left," Van Zandt said. Harvard now has switched OCI for 2010 to August. NALP's former proposal of restricting job offers to January was to allow law firms and law schools more flexibility in on-campus interviews during the fall, Van Zandt said. Waller, of the University of Illinois, said his only concern with NALP's idea of holding job offers back until January "was that we would end up putting students in a difficult position to find other opportunities if we waited" until the spring semester. Waller agrees with NALP's decision to shorten the allowed time for a student accept or reject a job offer from 45 days to 28 days. As to the overall scaled-down version of NALP's proposed changes, Waller said, "I believe the [NALP] membership as a whole appreciates the hard work NALP did. If it ends up being just incremental change, that works." Van Zandt said ultimately the whole recruiting process is broken. "Law firms come on campus, do 20 minute interviews," and neither the student nor the law firm gets any good information this way, he said. The law firm recruiter "gets back on an airplane and says, 'I met all these interesting people. How will I decide?" and every recruiter falls back to the same thing, grade-point average. Reduced hiring in the recession merely raised the GPA standard higher, in Van Zandt's view. "The real crux of the problem,'' Van Zandt said, is that law firms haven't yet figured out what they are looking for in a job candidate. He expressed the hope that law firms are developing pay-scale guidelines for their associates based on legal and other competencies, perhaps law firms will extend that experience to the recruitment process. Van Zandt said no other industry interviews job applicants two years before hiring them. He said a better system would be for law students to go out and find their own interviews and do these at law firms.

4—LEGAL EMPLOYMENT WEEKLY

Illinois Paralegal Association
SNOW DAY! By: Caren Mansfield, a member of the Illinois Paralegal Association I am just like the kids in school. I love snow days. When you live in the country like I do even a little bit of snow on a windy day can keep you off the roads. So even though I love my paralegal assignments, a snow day is a day to decompress. A snow day is “a whatever I want to do day”. A snow day is also a guilt free day. Really. Advisories tell everyone to stay off the road and be safe. If you live in the city, those sidewalks won’t be cleared and you can risk falling and hurting yourself. For just a little while, the snow is pristine, and you can remember to those days in your youth when snow was a wonderful thing. Take a snow day. Here’s my list for snow days: 1. Take a nap. Sure, you just got up in case you had to go to work, now you don’t have to go so, take a nap; 2. Read a book. You are not going any place. Pick a book and read for a while; 3. Go outside. It’s really nice to go outside and enjoy the snow when you don’t have to do anything else. You can shovel the sidewalk if you want but don’t overdo it. Or, you can be really community minded and shovel someone else’s sidewalk. Remember, the goal of a snow day is to have fun; 4. When you come in from making the snowman, having a snowball fight or making snow angels, it’s time for hot chocolate. 5. Watch something you would not ordinarily watch on TV. But let’s skip Jerry Springer! 6. Start a fire (in the fireplace if you have one). If you don’t have a fireplace, don’t start a fire! 7. If completing tasks makes you happy, balance your checkbook, do the laundry, run the vacuum cleaner, you get the picture. 8. If you have a dog or cat, spend time with the creature. Nothing is better to de-stress from our everyday lives that the unconditional love from pets. 9. Dance. Turn on one of the Michael Jackson specials, hit CMT, pick up one of the satellite music channels or pick up your iPod. Dance around the house. It really is good for you. You can’t help but smile and thank goodness no one is watching. 10. Take a nap. Nothing better on a snow day after all the activity is to get in another nap. You will be refreshed for tomorrow. Okay, so take my list a little tongue in cheek. I hope you get the idea I am after. Snow days can be wonderful, beautiful ways to relax without that feeling of guilt. If necessary, yes you can work for home but don’t miss the beauty of the day. All of the above is the opinion of the author and does not necessarily reflect the views of the IPA. For something more related to the paralegal profession check back next week. Call 815462-4620 or visit the IPA website at www.ipaonline.org. Contact Caren Mansfield at [email protected].
