Career Calisthenics: Whipping Your Career Into Shape

Getting any job in today's market is hard work-are you sure that you are doing everything you can to "work out" all your career opportunities? If you aren't putting in at least as much time and effort crunching your network as you are your abs, your career search isn't in peak form. As a career trainer for lawyers in transition, I feel a kinship with all the personal trainers I see at my local gym. In a lot of ways, we are in similar positions. We both have clients that come in to see us searching for direction. We both want to help our clients identify and reach realistic goals by offering directed exercises to help strengthen their resolve and sharpen their skills. We each relish in our clients successes and feel for them when they fall short. But whereas my compatriots at the gym can point to the loss of the first few pounds or inches to reassure their clients that progress is being made, my clients find it much harder to see success in anything less than the acquisition of a new job. We all know that Rome wasn't built in a day, and that (no matter what you read on the internet) washboard abs can't be obtained without sustained hard work. Yet so many lawyers lose patience and focus as soon as their first round of letters or networking attempts fail to yield a job offer. I guess the legal market was too good for too long; many of us have never experienced a real job search and the persistence that carrying out such a search requires. So pull on your sweats and lace up your sneakers-we are going for a trial run through the career obstacle course for getting a job in these tough times. 1. Bend and Stretch When you haven't been to the gym for a while, most trainers will start by checking your flexibility. They will push you and pull you to see where and how you bend, how "tight" you are, how flexible (or inflexible) you have become over the years. Where you start is just the baseline-you are expected to loosen up as you begin the training process. This holds true for career stretching as well. Are you hung up on only taking a job exactly like the one you held before? In this economy, the number of traditional legal jobs has shrunk considerably. You may need to figure out a way to stretch your technical and transferable skills into new and different configurations so as to be marketable in areas that are quasi- or even non-legally related. The good news here is that just as you can train your body and muscles to bend and move in different directions, you can reevaluate your intellectual skills and learn to see where and how those skills can be valuable in other places and industries beyond the law. This mental stretching can be as painful in its own way as the physical type. We all get comfortable with the routines we know and the comfort that comes with using our skills in the same ways over and over, but humans are flexible-we were designed to be adaptable to survive. 2. Start Slow and Steady No one would start a new exercise routine with a triathlon. That just sounds crazy. But many legal job seekers, in a panic to land something, do exactly that. Before they have even thought about what they might like to do or for whom they might be able to do their best work, they flood the market with their resumes. They network haphazardly. They act without a plan. And just like running a marathon without the proper training, they crash and burn, injuring themselves in the process. A smarter approach is to work up to being ready to present yourself to your target markets in a controlled fashion. I am all for maximizing contacts in a given arena, but I believe there needs to be a strategic component to who you target, when and why. I try and encourage my clients to learn something from every networking meeting they have, and then to dial that learning into the next level contact. When an opportunity is available for a position, submit a tailored resume and cover letter that speak directly to your qualifications for that specific position. Don't consider an afternoon on LinkedIn asking random folks to "friend" you as quality job search time. 3. Build On Your Progress In the gym, once you can do 10 push-ups, then you work toward 15. Once you can do 15 repetitions of your bicep curls with 10 pound weights, then you try it again with 15 pounders. Whether you are aiming for strength or flexibility or speed or stamina, you always keep building. A job search is like this as well. Even after you have had a few good interviews, keep plugging! Some jobs just won't be offered to you, despite a fantastic interview. Not all positions actually come to fruition; budgets or head counts can get cut even during an interview cycle. .And coming in second is not always a bad thing-even when you are not the one actually offered the job, being so close to the top should remind you that you did have most of what they thought they wanted for the slot, and you should reach out and investigate related jobs at related companies who might very well see the same positives in your background as did the first group. 4. Rejoice in Your Results Progress in the gym can be measured in lots of ways: increased strength, decreased pain, higher tolerance, lower weight. There are also intangible measures of success: you feel a little better, you have more energy, you look healthier. Plenty of tangible and intangible results can be yours from a well-conducted job search also. Your network increases, your confidence grows, your sense of where and how you can add value to an organization crystallizes. If you use your search time to volunteer or take an internship, you can develop new skills and realize the benefits of giving something back to your community. Best of all, these results are just as real as the new job will be, when you land it. So, if you can manage to stay on track with both your physical and job search routines, just think how great you will look (and feel) when you start your new position!

INDEPENDENT PARALEGALS/ FREELANCE PARALEGALS BY: Caren Mansfield, a member of the Illinois Paralegal Association Independent paralegals and freelance paralegals. Terms that float around all the time. While both names may be used interchangeably there is a difference. Let’s talk about the difference. Freelance paralegals are paralegals who are employed by attorneys, firms, corporations or agencies to work contractually. The freelance paralegal may perform work independently i.e. at home, at odd hours of the day or night but all work generated is reviewed by an attorney. Freelance paralegals are often used by firms to supplement staff when large projects or cases arise. Some freelance paralegals are hired as trial approaches to assist in preparing trial notebooks, interviewing witnesses and assisting counsel at trial. The freelance paralegal performs work under the supervision of an attorney. Independent paralegals are paralegals that perform work for the public without attorney supervision. They have also been called legal technicians or document preparers. This is a sticky area in Illinois. In Illinois a paralegal who prepares substantive documents for a client without attorney supervision is guilty of the unauthorized practice of law (UPL). A paralegal may provide independent services to the public through document preparation, research activities, filing services, etc. The consumer is not always aware that the independent paralegal can only provide published factual information (generated by a lawyer), cannot select appropriate forms and can only type in information given by the client. The paralegal cannot give advice, select forms, help with strategy or even describe what information should be included in a form. The independent paralegal can file and serve documents at the direction of the consumer. The decision on where (i.e. which court) to file the documents must be made by the consumer. Research must be directed by a client. Those decisions that paralegals routinely make in environments under attorney supervision such as drafting complaints, interviewing clients to solicit information and preparing court documents are forbidden for the independent paralegal in Illinois. Great care must be maintained by the independent paralegal not to cross over the boundaries to UPL. In Illinois there is no protection for the independent paralegal legislatively or the consumer. There is no statute that defines what an independent paralegal is or can do. Nor is there a recourse for the consumer who receives poor or inaccurate information from an independent information. A state that has taken action toward regulating independent paralegals is California. The law strictly defines what educational background and experience a paralegal must have before becoming a Legal Document Assistant. There is a fee to register and after posting a bond the paralegal can identify herself/himself as a Legal Document Assistant. Illinois is not yet to the point of regulating independent or freelance paralegals. That may come in the future. For now, both types of paralegals must be careful in not practicing UPL.
