ETHICS FOR THE PARALEGAL by: Caren Mansfield, a member of the Illinois Paralegal Association We are continuing our review of the Illinois Paralegal Association’s Code of Ethics. We are up to Rule Eight. If you have not been following this discussion please visit the IPA website to review the Code of Ethics. I know I keep saying – Wow, this is a big one but once again Rule Eight is a “big one”. Rule Eight focuses on Personal and Professional Integrity. This rule covers a broad area. First the rule directs paralegals not to violate the Code of Ethics. Second, it then broadly paints the picture of a paralegal just not doing anything that could be construed as unethical conduct from not inducing a person to engage in conduct in violation of these rules to not engaging in any unethical behavior individually. The Rule defines the conduct as any conduct involving dishonesty, fraud, deceit, misrepresentation or prejudicing the administration of justice. It goes further to address such issues as not defaulting on an student education loan, violating statutes that protect against age, race, sex, disability, religious and national origin discrimination. The Rule also directs if a paralegal who comes into knowledge that is not protected by these rules or the Rules of Professional Conduct of a judge’s or lawyer’s violation of the rules, that violation must be reported to the appropriate entity. Some paralegals hold public office. Rule Eight also addresses the ethical obligations of a paralegal in those circumstances. To put it succinctly, a paralegal should walk the straight and narrow line of ethical integrity and be aware of a duty to report violations on the part of others which may be covered by these rules or the Rules of Professional Conduct. Rule Nine brings us to the topic of safekeeping client property. While a paralegal may not have direct control over a client’s property we still have the responsibility to make sure any property is handled properly and in a manner which will keep it safe, secure and undamaged. Client property may include the client notes and files relating to a case to boats, houses, and other personal property. A more likely item of client property a paralegal may have indirect control over are the client funds deposited to an office trust or escrow account. Review the IOLTA rules to make sure there is no violation of these stringent rules relating to the handling of client funds. Perhaps the most tricky part of handling client funds is making sure the accountings are separate and any disbursements are made using that client’s funds and not relying on how much money is in the account which may or may not actually be the client’s funds. While the attorney is directly responsible for a client’s property, a paralegal may be the point person to become aware of problems relating to the property. Run, do not walk, to inform the attorney of such problems. Next week we will talk about Rules Ten, Eleven and Twelve. Stay tuned.
