13-645-Offered by Councillor Lungo-Koehn Be it resolved that the Medford City Council meet in a committee of the whole meeting to discuss the reserve Fire and Police lists especially due to the disadvantage that a reserve list for either department will have on our Veterans. 13-646- Offered by Councillor Lungo-Koehn Be it resolved that the City Administration update the Medford City Council on what step in the process we are on with regards to the possibility of a casino in Everett. Within the update please include, who will be paying for the impact studies that will be conducted, is Medford meeting all of our deadlines with regards to applications, have we been designated an impacted community and if so have negotiations begun?

13-647- Offered by Councillor Caraviello Be It Resolved the council discuss the current parking situation in Medford Square caused by the tenants of the 12 apartments on 20 High Street. The tenants are now parking in Medford Square taking up the precious few spots for the businesses and their customers. 13-648- Offered by Councillor Caraviello Be It Resolved that Board of Appeals revoke the special permit for a use variance Auto Repair/ Gas Station on 425 Main Street now that the present occupant has closed. This property has been a neighborhood blight and problem. 13-649-Offered by Councillor Penta Be It Resolved that the citizens of Medford be aware of the possibility of a Lawrence Memorial Hospital takeover and what affect it will have on our City.

Dear Mr. President and Councillors: I respectfully request and recommend that your Honorable Body approve the expenditure of $100,000 recovered through insurance for the purpose of: · Feasibility Study/Schematic Design for the Medford High School HVAC/Boiler replacement project as part of the Accelerated Repair Program of the Massachusetts School Building Authority (MSBA).

As you are aware, the council authorized the City to submit a Statement of Interest (Paper 13-346) to the MSBA on April 9, 2013. Subsequent to that, we were invited to participate in said program. The next step in this process is the completion of a Feasibility Study/Schematic Design. As you may recall, we previously appropriated $170,000 from this account for the MHS Science Lab Feasibility Study. Council then rescinded the vote and included said amount in the bond. Re: Resolution Prohibiting “Hookah” establishments in the City of Medford. Dear President Maiocco and Members of the Medford City Council: I respectfully request and recommend that your Honorable Body approve the following amendment to the Revised Ordinances of the City of Medford which would prohibit entities known as “hookah” establishments in the City of Medford. The following language has been prepared by the City Solicitor for your consideration. BE IT ORDAINED: By the City Council of the City of Medford that Chapter 58 of the Ordinances of the City of Medford, as most recently amended, is hereby further amended by inserting after the present ARTICLE II, the following 1. By Amending Sec. 58-42 entitled “Definitions” by the inclusion of the following terms: “Hookah Establishment, Hookah Parlor, Hookah Bar or Hookah Lounge”- any facility or location whose business operation, whether as its primary use or as an ancillary use, is devoted to the on- premises smoking of tobacco or other substances through one or more pipes (commonly known as a hookah, waterpipe, shisha or narghile) designed with a tube passing through an urn of water that cools the smoke as it is drawn through it, including but not limited to establishments known variously as hookah bars, hookah lounges or hookah cafes.” 2. Dear Mr. President and Members of the Medford City Council: I respectfully request and recommend that your Honorable Body approve the following Home Rule Petition entitled “An Act Relative to the Construction of a Municipal City Yard in the City of Medford”. This act would allow the use of a Project Labor Agreement and establish certain requirements relative to contractors and subcontractors to perform construction work for our proposed new City Yard. Among the benefits would be insuring union safety and training standards, a no-strike promise, efficiency, a process for grievances, establishing of wages for the duration of the project and setting stop and start times for work. In addition, this Home Rule Petition would exempt this project from the provisions of G.L. c 149 § 44F regarding the form and content of sub-bids. Be it enacted by the Senate and House of Representatives in the General Court Assembled, and by the authority of the same, as follows: SECTION 1. Notwithstanding the provisions of any general or special law to the contrary, in order to implement the construction of its new municipal city yard, the City of Medford may utilize a Project Labor Agreement. In addition, in constructing its new municipal city yard the City of Medford shall not be subject to the provisions of G.L. c 149 § 44F. For the purposes of this Act, the words “new municipal city yard” shall mean the construction and equipping of the municipal city yard in the City of Medford. SECTION 2. This Act shall take effect upon its passage.

Re: Resolution Regarding an Amendment to the Revised Ordinances of the City of Medford to enact a Moratorium on Medical Marijuana Treatment Centers in the City of Medford for a period of six (6) months Dear President Maiocco and Members of the Medford City Council:

I respectfully request and recommend that your Honorable Body approve the following amendment to the Revised Ordinances of the City of Medford which would put in place a moratorium on Medical Marijuana Treatment Centers in the City of Medford for a period of six (6) months. This moratorium would allow a sufficient period of time for the City of Medford to consider appropriate changes to our Zoning Ordinances regarding location and siting issues. The following language has been prepared by the City Solicitor for your consideration.
Notwithstanding any other provision contained in the Revised Ordinances of the City of Medford, no permit or special permit shall be issued for the use in the City of Medford for any medical marijuana treatment center as the same is defined in Chapter 369 of the Acts of 2012, regardless of the name or title by which such use may be called, prior to March 3, 2014. The prohibition on said permits or special permits is necessary in order to provide the City of Medford with adequate time to prepare comprehensive changes to the Revised Zoning Ordinances of the City of Medford, to address issues created by Chapter 369 of the Acts of 2012 and to assess the Act’s impact on zoning within the City of Medford consistent with the purposes of zoning and all other applicable laws, regulations and ordinances.

McGlynn 13-667September 6, 2013 To the Honorable President And Members of the Medford City Council City Hall Medford, MA 02155 Dear Mr. President and City Councillors: I respectfully request and recommend that your Honorable Body approve the following Loan Order Amendment: CITY OF MEDFORD, MASSACHUSETTS LOAN ORDER AMENDMENT BE IT ORDERED: That the Loan Order of this Council adopted December 11, 2012 (Ord. 781), which authorized the borrowing of $13,834,923 to pay costs of the development of new science labs at Medford High School, is hereby amended to permit the borrowing of any funds not required to pay costs of the City’s share of the science labs project, after the application of all grants payable to the City by the Massachusetts School Building Authority (“MSBA”) on account of the science labs project, to pay costs of storm drainage improvements in the Meetinghouse Brook area, which improvements shall include, but not be limited to: flood mitigation measures, culvert replacement, relief drain construction and the like. Any amounts to be expended for storm drainage improvements shall be borrowed pursuant to Chapter 44,

Section 7(1) of the General Laws, or pursuant to any other enabling authority. The total amount authorized to be borrowed by the City pursuant to the above described Loan Order shall be reduced to the extent of the grant amount set forth in the Project Funding Agreement between the City and the MSBA with respect to the science labs project.
