MCA BOARD MEETINGS ARE OPEN TO ALL MONTPELIER HOMEOWNERS
Mark your calendar for Tuesday, November 11 and Tuesday, December 9 for the monthly board meet-
ings at Deerfield Community Center, preschool room. All meetings begin at 6:45 pm.
MCA Board meetings are held the second Tuesday of every month.
Montpelier homeowners are encouraged to attend.
Dear Neighbors,

Thank you for the opportunity to be one of the tem-
porary guardians of the wonderful Montpelier
community.

After only one meeting it is apparent that your
newly installed 9-member Board provides the di-
versity necessary to make sound decisions for our
Community. We have Trustees from many walks
of life with vast experience and enthusiasm to care
for Montpelier. Add to this the interested neighbors
that attend the Board meetings, on the second
Tuesday of every month in Deerfield Recreation
Center, and you have just about every point of
view covered. When all of your opinions are con-
sidered we have better results.

We want our home values to stay high, our
streets to be safe and neighbors that we can
depend on. This has happened for over 40 years
because of the sound leadership from past Boards
and their adherence to the Governing Documents.
The Documents consist of the Articles of Incorpora-
tion, which created our Association and were
signed February 14, 1966; the By-Laws, which di-
rect how we will govern ourselves, revised October
14, 2002; and two Declarations of Covenants, one
for the Common Areas and one for the Lots. All
are available on www.MontpelierOnline.com.

The Governing Documents Committee is reviewing
the recommendations from last year’s efforts and
will consider what, if any, action to recommend.
The Committee will keep the Board informed at
the monthly Board meetings and Article XV,
Amendments, covers how the By-Laws can be
changed.

In addition to supporting the Architectural Con-
trols and Compliance Committee, the Board
must ensure that the common grounds are
maintained in good repair and condition. To
determine what needs to be fixed or replaced, we
are going to establish a prioritized list of what
needs attention. Clearly not everything can be
fixed in the first year, so this will look more like a
five-year plan; so many opportunities exist to pro-
vide your input over the next few years. Small
items are covered in the Annual Operating Budget
and the community maintains a Capital Reserve
Fund for the big items with sufficient controls in
place to keep that fund solvent.

If any of the above encourages you to come to the
Board meetings, on the second Tuesday of every
month in Deerfield Recreation Center at 6:45
pm, that is a good thing, since your voice will be
heard.

Zev Sheppard, the eleven year old grandson of
longtime Montpelier residents Gail & Paul Katz,
was selected to be a "People to People Ambassa-
dor" a program started by President Eisenhower
and supported by every President since. The pro-
gram's objective is to promote international under-
standing by bringing together young people from
around the world and educate them in national and
international affairs. Zev's week long program, in
late October, will include lectures and visits to
members of Congress, Williamsburg, and Gettys-
burg. Zev is now a 6
th
grader and lives with his par-
ents Hubert and Stacy Sheppard and sister Zoe.
Zev was also a 2007 winner of a Dr. Ben Carson
college scholarship.

Many thanks to Dawn Puma for the many years of
help in providing the MCA resale packages — es-
pecially during the height of the housing boom
when the resale packages were flying out of her
hands! Dawn is still active on the Elections and
Governing Documents Committees, but she de-
cided to turn the Resale Packages over to another
great Montpelier volunteer, Jeri Witt. Thanks to
you both!

To Whom It May Concern,
I would like to take this opportunity to tell the MCA board that my family and I had a fantastic year at the
Montpelier Swimming Pool this summer. The staff was friendly, attentive, and knowledgeable. I always
felt that my ten year-old girls were safe when they were swimming in the pooi, because the lifeguards
were doing their jobs properly, including keeping children in check.
The grounds were well kept and tidy, the water appeared to be clean and pool furniture was in good
condition.
I believe that a lot of the credit for running the pool smoothly must be credited to Lynne Gerlach, the life-
guard in charge. I think she did an outstanding job and I hope that she will be hired again next year as
head life guard.
I also thought it was a great idea to have people from the community man the front desk. It seems like a
great way to build community.
We already are looking forward to next year!

We also want to thank the Pizza Moms, Lynne
Collman, Susan Thompson, Joyce Hartwig,
Marie Epplemen and Dawn Puma for keeping
the tradition of Wednesday Night Pizza at the Pool
alive, and Bob and Mary Derrick for organizing
several pool parties, obtaining ping pong tables, a
refrigerator/freezer and keeping the propane tanks
full!

At this time, we should also thank our outgoing
Board of Trustees Kendra Wagner, Terry Row-
land, Minnie Clark Lamar, Julia Coldren-
Walker, Patricia Eisenberg, Sandy Martin, Paul
Petit and Trish Douville and our interim treasurer
Jeri Witt for all of their hard work. Paul and Trish
are also on the Board of Trustees for 2008-2009.

Trustee Wagner called the meeting to order at 2:00
PM. A quorum was present for conducting business.
Trustee Wagner announced the close of balloting.

Secretary’s Report: M. Clark-Lamar
Trustee Clark-Lamar asked the membership to re-
view the annual meeting minutes. A motion was
made and seconded to approve the minutes. The
minutes were approved unanimously by the mem-
bership.

Treasurer’s Report: J. Witt, interim Treasurer
J. Witt presented a proposed budget to all members.
(Copy attached). A member asked for clarification
on the expenditure for locking the gates. A member
asked about audits for 2006 and 2007. The interim
treasurer explained that the records had not been
kept in a manner to facilitate an official audit, but she
is working with the accountant and there will defi-
nitely be an audit of 2008.

Committee Reports
Trustee Wagner thanked Trustee Petit for his help as
Facilities Chairperson and Trustee Douville for help-
ing at the pool. M. Derrick was thanked for hosting
several parties at the pool this year. The Montpelier
Mansion and Arts Center were thanked for their as-
sistance also. Trustee Wagner also thanked interim
treasurer, J. Witt, for working so hard with the ac-
countant to get the association finances in good or-
der. V. Kaplan was thanked for volunteering to keep
us updated on new roads and projects which might
impact our neighborhood.

Communications – T. Fleming, Chairperson, distrib-
uted results of a survey he conducted regarding the
community list servs. The original list serv is pri-
vately owned and the owner no longer lives in the
area. At the request of the board, an “official” Mont-
pelier list serv was created. He also asked for com-
munity input regarding moderating and admission to
the list. Those present at the meeting felt that dis-
cussion should not be limited, excepting objection-
able language; they preferred to use one list, the
“official” Montpelier News list; and they agreed to
limit membership to owners, renters and elected offi-
cials.

Elections – P. Collman announced the names of the
new Board of Trustees: Richard Dengler, Bob Der-
rick, Patricia Douville, Lillian Fazio, Damian Fe-
doryko, Chris Harris, Tim Jacobs, Jack Keating, and
Paul Petit.

Governing Documents – J. Witt, Chairperson, in-
vited interested members to join the committee. A
survey will be prepared to use as a guide in revising
the governing documents.

Architectural Control & Compliance – M. Segura,
Chairperson, invited the membership to attend
ACCC meetings which are held on the first Tuesday
of every month. A member asked about some of the
architectural changes that the ACCC has allowed.

Security – R. Dengler, Chairperson, thanked every-
one who contributed to the Findley Fund to benefit
the family of the slain police officer. He asked for
information regarding an incident on Cedarbrook
Lane. He also asked for residents to be aware of the
ownership of homes if possible because of problems
in vacant homes.

Old Business:
Trustee Rowland made a motion to accept the new
GDC committee members and J. Witt, Chairperson.
K. Wagner seconded and the motion passed unani-
mously.

New Business:
P. McCullagh thanked K. Wagner for her work on the
board.
The new board members were introduced.

The meeting adjourned at 3:30 pm.

The new Governing Documents Committee meets

Monday of each month, 7:30 pm at Deerfield
Run Community Center. We need input from the
community as to what bylaws you think need to
be changed. We are working on a survey, which
we hope to publish in the January newsletter.
This survey will help to guide the committee on
the issues most important to our homeowners.

In the meanwhile, if you have any suggestions for
questions you would like to see on the survey, or any
specific bylaws you would like changed, please email
me at [email protected], call me at 301 498-
2043 or call any committee member so we can incor-
porate your suggestions into the existing survey.
You can also mail your ideas to P.O. Box 2503, Lau-
rel, Md. 20709.

As you know, bylaw changes are a very controversial
issue, not easy to change, and something we all
have to live with, not to mention our Board has to
uphold. In that vein we need to make sure we get it
right the first time and we can’t do that without your
input.

President, Kendra Wagner, called the meeting to
order at 6:50. There was a quorum present to con-
duct business.

Secretary’s Report: Minnie Clark Lamar
The June minutes were read and a motion was
made by Trustee Rowland and seconded by Trustee
Wagner to accept the minutes. The motion passed
unanimously.

Treasurer’s Report: Jeri Witt
The financial report was distributed by Ms. Witt (see
attached).

There is a bolt missing from the playground equip-
ment. Mr. Petit will repair same.

Gate Attendants: Jeri Witt
See Attached report. Gate attendants are monitoring
the number of people at the pool after 8:00 for later
discussion of feasibility of keeping the pool open until
9:00.

Pool Committee: Patricia Douville, Chair
Everything at the pool is going well. We need signs
to tell people to take showers prior to entering the
pool and the instructions when there is lightning.
Richard Delaber, the police officer who was given a
guest membership should use lot #700. The broken
shower has been fixed and some minor repairs done
by Lighthouse. Lynn Gerlach has requested a copy
of the pool contract. Discussion held regarding hav-
ing a second guard up when the well is crowded.

Trustee Eisenberg had to leave so there was no quo-
rum and the meeting was adjourned at 7:28.
The next meeting will be held Tuesday, August 12,
2008 at Deerfield Community Center at 6:45 pm.
ACCC REPORT
July 2008

The Board received an email from the Accountant
regarding his inability to do the 2006 audit. The
2007 paperwork is formatted the same so he will
probably not be able to do that also. He is out of
town until the end of July - when he returns I will set
up an appointment with him to go over his require-
ments for 2008.

As of this afternoon we have had no responses to
our ad for an Administrative Assistant for the Treas-
urer.

replacement of existing cedar shakes with composite
and painting shutters
9200 Pleasant Court - Letter to be written concerning
debris on front porch
12419 Radner Lane - approved replacing a chain
link fence with a 4 ft. wooden fence.
12303 Starling Lane - approval for 6 ft. fence due to
special security concerns.

There being no further business the meeting was
adjourned at 8:20. The next meeting of the ACCC
will be August 7, 2008 at 7:00 Deerfield Community
Center.

At the present time there is $314,694.77 in the
MCA Reserve Fund which breaks down as follows:
$167,197.47 in 15 month Certificates of Deposit
with interest on the average of 4%. The interest
rate on these CD’s, after 6 months, can be renego-
tiated up if the bank interest rate on CD’s in-
creases.
$147,497.30 was put into 7 month CD’s as there
was discussion at the spring board meetings re-
garding repairs needed at the pooi after the Becht
report was received but there was not sufficient
time to do the repairs before the pool opened for
the summer.
The Gypsy Moth Fund is on a 15 month, renegoti-
able CD with a balance of $29,747.96.
The Benevolent Fund is in a Premium Money Fund
(savings account) with a balance of $5,487.12.
The other Premium Money Fund, with a balance of
$43,551.24 is the overflow from the checking ac-
count which can be moved back into the checking
account when needed.
The checking account balance is: $22,663.72 in-
cluding outstanding checks.

Report from the Ad Hoc Tennis Committee
A new first-class fiberglass tennis rebound back-
board was installed at the tennis courts by Don
Keister, Rob Phillips and Jim Harkins. The board
is ready for play and we hope it will get a lot of use
as a practice aid for the community tennis players,
including beginners.

The board is of all weather fiber glass construction
and should last many, many years. It is 12 feet
wide and 8 feet high. It was installed on the fence
adjacent to the baseball field at the back of court
No. 2. That location was selected to allow com-
plete use of the other three courts at the same
time as anyone may be using the backboard.
Also, it was installed on the side that is adjacent to
the ball field as opposed to the side adjacent to
Briardale Lane so as to avoid any errant tennis
balls causing an annoyance to those living on
Briardale across the street from the tennis courts.

The meeting was called to order at 7:05 pm. Atten-
dance was taken and the August, 2008 meeting
minutes were amended and approved unani-
mously.

Old Business:
12815 Fernwood Turn – Community Standards
notified. The wrecked car is gone.
12203 Brittany Court – Repairs to house and yard.
Statement of fines sent. Hold to next month.
12101 Mt. Pleasant Drive – Dead arborvitae; no
response to letter. Hold to next month.
8785 Oxwell Lane – No response to letter regard-
ing damaged vehicle in driveway. Hold to next
month.
9200 Pleasant Court – No response to letter re-
garding debris on front porch. Hold to next month.
9203 Twin Hill – Homeowner and neighbor at-
tended the meeting and presented photos and
completed paperwork. The placement and the
height of the fence was allowed because the preex-
isting, neighboring fences have boxed his property
and created a unique security issue. R. Lenart
made a motion to fine the owner $100 for failure to
seek prior approval. B. Dennis seconded. The
motion failed with T. Jaehnigan, M. Boddie, J.
Keating and M. Segura voting against. M. Boddie
made a motion to impose a $300 fine for no prior
approval. B. Dennis seconded and the motion
passed with R. Lenart opposed. The homeowner
was advised of his right to appeal the committee’s
decision to the board.

and driveway being paved.
12704 Silverbirch Lane - The deadline for comple-
tion of the work has passed. M. Boddie made a
motion to impose a fine of $500 per month as of the
date of notification. T. Jaehnigan seconded and
the motion passed unanimously. A letter will be
sent.

New Business:
The committee discussed asking the new board to
send new homeowners some notification that they
should possess and read the governing docu-
ments.
12205 Brittany – D. Sowle reported the house is
vacant and for sale and very overgrown. She will
follow up with real estate agent.
12218 Shadetree – New shutters and windows ap-
proved.
12501 Silverbirch – Section IV, Bylaws, Article X,
Section 1, subsection h. Limitation states that a
decision by the Board is final and if further action is
initiated…, it will be through legal proceedings in a
court of law. J. Keating made a motion to ask the
board of trustees if the ACCC violated the govern-
ing documents when they reversed their decision in
the matter, and if so, what action should be taken.
The motion was seconded and passed unani-
mously. A letter will be sent to the homeowner.

There being no further business the meeting was
adjourned at 8:38 pm. The next meeting of the
ACCC will be Thursday, October 2, 2008 at 7:00
PM at Deerfield Community Cente

COMMITTEE MEMBERS ABSENT WITH CAUSE:

The meeting was called to order at approximately
7:40. Nominations were made for the position of
Chairperson. Dawn Puma nominated Jeri Witt and
it was seconded by Susan Habig. Jeri Witt was
elected by unanimous vote.

We are fortunate to have 2 past Board members, 2
members of the original Governing Documents
Committee and 2 past ACCC members on this
committee plus 3 relatively new homeowners so we
should be able to get the prospective of all commu-
nity members when formulating changes to the cur-
rent Bylaws.

A question was raised about Board approval for the
committee. Ms. Witt explained she had sent an
email to the Board asking for permission to start
this committee. Two Members of the Executive
Committee and 5 Board members emailed back
their approval. There was not a quorum for the
September Board meeting so official recognition
will be sought at the October Board meeting.

Since Board approval did not come in time for the
September newsletter it was decided that a notice
would be put in the next newsletter asking for more
volunteers.

It was decided that a notice would be sent to the
entire community asking their opinion as to what
Bylaws should be changed and why via the No-
vember newsletter. After further discussion this
decision was enlarged to questions including the
Covenants and general community concerns. We
are hoping to take the information gathered from
the newsletter and have it compiled into survey
form by the end of January.

It was decided that we would break up the presen-
tation of the proposed Bylaws into 2, possibly 3
special meetings instead of trying to present it to
the community all at once. It was also decided that
the committee would work as a group and not
break up into sections as was suggested. Mary-
beth Snead offered to computerize the current by-
laws to make them easier to work with.

The next meeting is scheduled for Monday, Octo-
ber 20, 2008 - location to be announced at a later
date.
SECURITY REPORT
There was a recent problem with trespassers in a
vacant home in Montpelier. The police have a
difficult time evicting trespassers if the owner of
the property cannot be located or contacted. It is
suggested that any property owner file the follow-
ing “Agent of the Property” letter with the local
police department if the property is going to be
vacant for any period of time.

enforce trespassing violations for the property

There have also been some break-ins of homes
in the vicinity of the WSSC property near Royal
Ridge Lane. They have all occurred in the day-
time hours when no one was at home. Jewelry
and electronics have been stolen. Please keep
an eye out for any unusual activities. If you no-
tice a strange vehicle, jot down the car make,
model and tag number if possible. Give the infor-
mation to me to compare with legitimate home-
owners or visitors in the area and I will pass any-
thing on to the police. Of course, if you witness
anything strange, call the police to report it.

CONSTRUCTION, ADDITIONS OR
ALTERATIONS
REQUIRE PRIOR APPROVAL

No new construction, addition, or alteration of a
Montpelier home shall be made without prior ap-
proval (see approval form on following page)
from the Architectural Control & Compliance Com-
mittee. This includes satellite dish installation.
All exterior colors and materials shall blend
harmoniously with the neighboring dwellings.
Proceeding without prior approval shall constitute a
covenant violation subject to enforcement, includ-
ing fines.

BOAT, CAMPER, RV, TRAILER
POLICY

Boats, campers, RVs, and trailers must be in stor-
age from November 1 through April 30. They may
not be stored or parked on your property.

UNLICENSED CARS


Article IV, section 5 of the covenants states no ve-
hicle can be stored on any lot except inside the
garage. All cars, covered or uncovered, must have
a valid license tag and sticker. Residents may be
required to provide proof of licensing if the license
tag is not clearly visible on the vehicle. In addition
to the covenant above, Prince George’s County
Code states “it is unlawful to have more than one
motor vehicle ... dismantled, inoperable or unli-
censed on your premises. The one vehicle that is
allowed must be inside a closed garage.”

USE OF PODS, DUMPSTERS,
ETC.

Approval must be obtained from the ACCC before
placing a PODS, dumpster, or similar structure on
any lot. The maximum time that the structure can
be on the lot must also be approved by the ACCC.
Failure to obtain such prior approval will result in a
fine of up to $1,000. Failure to remove the struc-
ture within the agreed time limit will result in a fine
of up to $500 per month until the structure is re-
moved or approval for an extension is obtained.
