RESTRAINING ORDER E ME RGE NCY   MOTION FOR TEMPORARY RESTRAINING AND PRELIMINARY INJUNCTI INJUNCTION ON COMES NOW the P laintiffs laintiffs Ma tt tthew hew Parr Parr individually and A.V.H. B/N/F Matthew Matthew Parr in the  above-styled   a n d  numbered matter a n d  respectfully moves this court pursuant   to temporary restraining order entered entered upon the pleadings and Rule  65 for entry of an imm ediate temporary thereafter a preliminary   injunction entered   following   the requisite hearing restraining

Jones hereina fter referred to as Defen dant from   administering Defendant Jill Patrice Jones possessing or  requiring  th e  ingestion  of any  m edication edication n ot  ordered   a s  medically n ecessary ecessary   to C.C.H. and A.V.H. by a licensed medical provider and  from   coercing threatening or  any consequence or punishment on said children for  refusing  to take any implementing any implementing medication not med ically necessary. In support of said said Motions for immediate temporary restraining order entered upon the the pleadings and thereafter a preliminary injun ction entered entered following  requisite hearing Plaintiffs   state as follows:

occasions as outlined in in the the above-sty above-styled led and numbered C ompla int 1.   On one or more occasions Defendant  has coerced mino r child A.V.H. ttoo ttake ake against her will prescription prescription b irth

control pills through  use of  threats   of  social isolation   a n d   other consequences.

 

2.   Plaintiffs   C.C.H. age 16 and A.V.H. age   15 are competent and capable of asserting their  right  t o  refuse  medical treatment treatment  i n  decisions that   a re  non -life threatening threatening

independently of the the State or its its agents. 3. A.V.H.  does  n ot  wish  t too  take birth control  pills  because   she iiss not  currently sexually

active. Her right right to to choose regarding regarding contraception ha s bee beenn established in R oe v. Wa de. 4.   There  is no  lawful   order b  byy a  Court  i n  place  nor any  statutory authority which grants Defendant any  right  t o  require  non-life   saving medical treatment   n o r  have   th e   parental rights of   Ma tthew Parr granted by the  2 88 th  Judicial District Court  i n  Bexar County Texas been terminated.  N o  Court  h a s  found   A.V.H.  or  C C H to be  incapable o  off  making

decisions regarding their  o w n  healthcare  o r  restrict  restricting ing them  from   exercising their right right  t o refuse   treatment.

5. Defendant   is a  registered as  such   is  required to  know t the he  content  registered n urse and urse  and as such  required   to know  content   a n d

requirements  s et  forth  in the Nurse Practice Practice Act and the Ru les and Regulations Regulations of the Board of  Nursing  for the   State  o f  M ississippi. ississippi. 6.   Plaintiffs   have  n o  alternative remedies  at law or in  equity. 7 .  Th e   relief requested   by   Plaintiffs   is  necessary   to  protect   Plaintiffs   from   substantial   a n d

Based   on   Plaintiffs Complaint  a  and nd  Motion  f foo r  Temporary Restraining Order,  the  t he  Court  finds sufficient   grounds   fo r  concluding that irreparable  injury   to  Plaintiffs   will likely occur absent absent

entry   of a temporary re strainin g order. Therefo re, it is hereby ordered as follows : 1.   Defendant  Jill  Patrice Jones   is  tem porarily restrained restrained   from   obtaining,  possessing or  o r

administering administ ering directly or indirectly any prescription prescription or over-the over-the counter medic ation to  childrenn A .V.H.  o minor  childre  orr  C.C.H. 2.   Defendant Jill Patrice Jones   is  tem porarily restrained restrained   from   initiating  a ny  conversation

with minor ch ildren C.C.H. or A.V.H. conc erning medical care or treatment. 3.   This temporary restraining restraining order shall shall expire expire  in ten  days unless  it is  extended   fo r  good

cause shown   by  further   order  o f  this Court. 4.   This temporary restraining order shall become  effective   immediately upon entry by the

Court.  Plaintiffs   are not required required to post a bond or other security.
