On August 7, 2015, Jody Herring of Barre, Vermont, at Barre, Vermont, in
this county and territorial unit, was a person who unlawfully, willfully,
deliberately and with premeditation killed another person, to wit; by shooting
Lara Sobel, in violation of 13 V.S.A. § 2301 and against the peace and dignity
of the State.
PENALTY: Pursuant to 13 V.S.A. § 2303(a)(l) imprisonment for a minimum
term of not less than 35 years and a maximum term of life, or imprisonment
for life without the possibility of parole.

Now comes Detective Sgt Hal Hayden, affiant, being duly sworn and on oath, deposes and
says he has probable cause to believe that Jody L Herring DOB/09-11-1974, has committed the
offense of Homicide , a violation of Title 13 Vermont Statutes Annotated Section 2301.
This affiant is a.full time law enforcement officer employed by the Barre City Police Department
since 1985. I h.ave been certified as a Law Enforcement Officer by the Vermont Criminal Justice
Training Council and am currently assigned as a Detective Sergeant.
On Friday afternoon, August 7th, 2015 at approximately 1654 hrs I received a call from Barre
City Dispatch informing me that there had been a shooting behind City Place located at 219 N

Main St in Barre City, Vt. I was also informed that the victim was Lara Sobel
social worker from the Department of Families and Children which has offices in the building.
On my arrival on scene at approximately 1710 hrs I observed the crime scene secured by
members of the Barre City Police Department and Vermont State Police, they were still in the
process of putting crime scene tape out to secure the entire area.
What appeared to be a body was lying near the corner of the building covered from public
viewing. I was briefed by Sgt. Steve Durgin and Cpl. Jonathan Houle as to what transpired prior to
my arrival.
I was informed that the victim (Lara So bel) was walking at the rear of the building when she was
approached by a woman, later identified as Jody Herring, with a rifle. Herring then shot the
victim, causing her to fall to the ground, after which Herring shot her again.
I was informed that Scott Williams, Washington County States Attorney, was at the Rehab Gym
located in the same building when he heard shots fired. Mr. Williams approached the scene and
saw the victim lying on the ground and the accused still there with a rifle in her hand. I was
informed that Mr. Williams managed to get the gun away from the accused and with the help of
bystanders was able to subdue the accused until police arrived.

"On August 7th 2015, at approximately 1645 hrs. I was on uniform patrol duty for the Barre City
Police Department. I was in a fully marked police vehicle. I was dispatched to The City Place
located at 219 North Main Street in Barre City, Washington County Vermont for a report of two
gun shots. I was informed that one female was on the ground and that witnesses had one female
iri custody. The description of the female suspect was given as a wearing a black tank top and
grey pants with long blonde hair carrying a long gun.
Upon arrival I spotted a female matching the description given being held by her wrists by a male
who was later identified as Greg W. McNaughton
. The male advised that the
female he was holding onto had just shot the female lying on the ground and he was keeping her
on the scene.
The weapon used was recovered at the scene by the Vermont State Police Mobil Crime Lab while
processing the scene and was found to be a Remington model 700 .270 caliber serial #E6390719.
Once back at the Barre City Police Department the female was transported into the processing
room. The hand cuffs were taken off of the female. The female was then instructed to remove all
of her jewelry, belts, and shoes. The females advised "that they were not shoes they were boots."
I said shoes boots same thing take them off. She removed her shoes and all items she was asked
to remove.
While the female was attempting to take her belt off I
noticed a clear white plastic rectangle shaped item inside her front waistband right behind her
belt buckle. She said something to the effect of "you might want these I don't need them
anymore." After she said that she pulled the rectangle plastic shape out of her waist band .the

plastic shape was what appeared to be a sleeve of rifle bullets that was partially empty. The
sleeve only contained a few bullets. The bullets inside of the sleeve were .270 caliber rifle rounds.
The female was very calm and laughing during the entire interaction. The female was placed into
cell #2. Due to the clothing having the reddish brown substance on them Barre City Dispatch had
Lt. Fire Fighter Nicholas Copping retrieve a pair of scrubs. He sent a Barre City Fire fighter to the
Central Vermont Medical Center for the scrubs. Prior to the scrubs arriving I entered into the cell
to take pictures of the reddish brown substance on the clothing with Barre City Police Officer
Chad Stacey. While taking the pictures I noticed that the female had removed the substance from
her clothing but you could still see the outline of the location on the clothing. During the time it
took to·get the scrubs Barre City Dispatch had a female officer from Montpelier Police
department arrive to assist with removing the clothing from the female
It should be noted that while on scene the female was laughing about the incident and very calm.
During transportation the female continued to laugh and talk about the victim. Prior to placing
the female into the cell she was still laughing and making small talk about the incident like it was
no big deal."

Later in the evening I met with Detective Sgt. Todd Baxter who briefed me regarding an
interview he had with a witness, Karlyn Sizemore
Ms. Sizemore informed Detective Baxter that she and her son, Keith Miller
were working as maintenance personnel at City Place on Main St. in Barre Vt. as they drove
behind the building with Karlyn driving and parked to go into the building, At this time she
parked right next to a vehicle with a woman in the driver's seat and appeared to be obviously
turned in so that she was pressed up against her driver's door, as though to position herself for a
better viewing of something.

When Karlyn got out of the car she dropped her cell phone and retrieved it, and as she stood up
she was face to face with the operator of the vehicle beside her, who was screaming about
something. There was no other occupant in the vehicle, and her hands were flailing. Sizemore
also noticed something black on the passenger's seat which, in hindsight, she believes may have
been the butt end of the weapon.
As Karlyn and Keith walked toward the building she noticed a woman walking with a man she
thought was named "Scott" and thought he was a DCF worker, and she knew the woman to be a
DCFworker.
As they passed by the couple, within seconds she heard a loud blast which made her ears ring. As
they turned around they saw the woman previously sitting in the car next to theirs yelling and
saw the victim lying on the ground. They then witnessed the accused shoot the victim a second
time as she lay on the ground.
Karlyn described the woman as having blonde hair, wearing a black shirt and jeans. She further
advised the accused was shouting something about her 8 year old daughter being taken by DCF,
and was waving a long barrel gun around. They then observed three men approaching-who
wrested the woman with the gun to the ground. This woman was identified as Jody Herring
(DOB: 09/11/74)

was interviewed by Officer Chad Stacey and advised Officer
"I heard two bangs come from just outside the window. When I opened the blinds I saw a
woman on the ground with blood pooling around her and a woman standing several feet away
from her holding a large black gun/rifle. I proceeded to call 911 and when I went back to the
window the woman no longer had the gun and I couldn't see it". End statement.

"I was walking past Jerrys Sports Tavern through the back parking lot and stopped to talk to
people I knew. I heard a shot (gun) and stepped out from around the vehicle I was standing and
saw a person lying on the ground behind the Barre City Place on the sidewalk. I also saw a blond
haired woman yelling at her and raise a weapon and shoot her while she was laying on the
sidewalk. I immediately called 911 and described everything. I saw and heard the 911 operator
ask me to secure the weapon which I did until police arrived. I then just followed the officers
directions." End of statement
During the late evening of 8/7/15 myself and Det Sgt Mark Potter attempted to interview Jody
Herring at the Barre City Police Department.· From the onset of asking if we may speak with her
the Herring was quite agitated, and became increasingly so as we walked to the second floor
interview room.
Herring was ranting about how the police never did anything for her, about how she had been
beaten by a former boyfriend and nothing was done and about the injustices suffered at the
hands ofDCF.
Attempts to calm the Jody Herring were unsuccessful and after about ten minutes she said she
was done talking with us and we escorted her back to her cell.
On 08/08/15 State police detectives Doug Norton and Mike Notte interviewed Dwayne Herring
who is Jody Herring's brother at approximately 1650 hrs. regarding his contact with his sister.
Dwayne Herring advised that on Friday he had received several call from his sister on 08/07/15
and that she had left two messages.
The first message was at 1456 hrs. and the message was "If you think anything of your sister
you'll get a holc;l of me now or ASAP" words to that effect. The second message was at_lSOO hrs.
and Dwayne advised the Jody sounded hysterical and said "watch the news you'll wish you got
ahold of me earlier".

Now comes Detective Sgt Hal Hayden, affiant, being duly sworn and on oath, deposes and
says he has probable cause to believe that Jody L Herring DOB/09-11-1974, has committed the
offense of Homicide , a violation of Title 13 Vermont Statutes Annotated Section 2301.
On Saturday, 8/7/15, I reviewed a vide·o taken by a surveillance camera that monitors the back
parking area of Barre City Place. The video shows a female sitting in a silver car who then exits
the vehiCle brandishing a long gun. The video shows her walking towards the rear ofthe
building. She then shoulders the weapon, and then quickens her pace rapidly before going out of
. sight off camera. The female was subsequently identified.as Jody Herring and the vehicle she got
out of was registered to her.
During the morning briefing on 8/9/2015 Detective Angela Baker informed me that during an
interview with Keith Herring he revealed that he was waiting in the parking lot by DCF for his
foster child on 08/07/15 between 1530 and 1600 when he observed Jody Herring driving slowly
through the parking lot and looking up in the direction of the DCF offices.
On the afternoon of Saturday, August 8th 2015 myself and officers from the Barre City Police
Department and Barre Town Police Department executed a search warrant at the residence of
the Defendant
in South Barre, Vt.
Among the items seized were 34 spent Winchester .270 caliber shell casings, two empty
Winchester .270 caliber boxes, and one Winchester .270 caliber box containing fourteen live .270
caliber rounds. Lying on the bed beside the above described ammunition was a receipt from
Walmart in Berlin, Vt dated 6/2/15 in the amount of $20.08 for the purchase of ammunition
(unspecified).
In a subsequent search of the Jody Herring's vehicle which had been in the DCF parking lot at the
time of the shooting, which was also included in the search warrant, officers found an empty box
of .270 caliber Federal ammunition as well as a full box of .270 caliber Winchester ammunition.
Preliminary information from the. autopsy of Lara Sobel on 08/08/15 has her cause of death as
rifle wound/2 oftorsojupper extremities. Additional information indicated by stippling on the
body indicates that at least one of the gunshots was at close range.
