A man has been awarded €1.2 million for a personal injury he sustained at work. The injury occurred when the plaintiff fell over six meters, almost 20 feet, from a raised forklift platform at work. Initially Martin Casey, trading as JMC Engineering of Brantry Road, Dungannon, Co Tyrone, and quarrying company Kilsaran Concrete Ltd, Piercetown, Dunboyne, Co Meath denied any liability for Mr Lenagh’s injuries. Mr Lenagh in a statement alleged that “the defendants instructed or allowed him to use a forklift which had not been fitted with any safety rail or cage when it was used to elevate him more than six metres to provide him access to a conveyor belt.” He also claimed that there was no suitable working platform provided, such as a cherry picker which could have allowed the work to be done safely and ask for work accident compensation. The accident occurred back in November 2002, on premises owned by Kilsaran, in Duleek, Co Meath. Mr Lenagh was in a coma for almost a month post-accident and suffered significant brain damage as a result: according to his statement these injuries have had an extended effect on his ability to walk, his speech and his memory. His poor balance, and loss of short –term memory, as a result of the incident are likely to have a negative impact on his ability to secure work for the foreseeable future: due to the nature of his post. Pádraig McCartan SC, for Mr Lenagh, said “Mr Lenagh will require constant care”, and his wife has given up her job to look after him. Mr Justice, John Quirke agreed the settlement and directed that €1.2 million be paid into court, pending an application being made in Northern Ireland, for Mr Lenagh to be made a ward of court. It has a long, and no doubt an uphill battle fir Mr L since the incident but today he was finally compensated for his loss and suffering.
