La importancia política de los inmigrantes en los Estados Unidos no es nada nuevo. Aventureros y negociantes del voto aplicaron una medida certera en la época del gran movimiento migratorio europeo hacia los Estado Unidos durante la segunda mitad del siglo XIX. Los esforzados militantes demócratas del Alcalde de New York Fernando Wood, abordaban a cada inmigrante mayor de edad que desembarcaba en el puerto de la ciudad ofreciéndoles la nacionalidad inmediata a cambio de que votaran por el Alcalde, quien buscaba un segundo término de mandato. Llegó a tanto su audacia que los miembros de la banda “los conejos muertos” que le apoyaban, recorrieron los cementerios recaudando nombres de “votantes”. Como la historia siempre nos enseña, también en estos tiempos los inmigrantes vuelven a la palestra política. Tiempo de elecciones y la voluntad expresa de la administración de Obama de no deportar más jóvenes que puedan calificar para el Dream Act, debe ser vista en ese contexto. Claro que acá surge una pregunta y es ¿cómo van a influir en las votaciones, por ejemplo los padres de ese millón de niños que podrían calificar al Dream Act? A primera vista, de ninguna manera porque precisamente sus padres son indocumentados y están muy lejos de poder votar. Sin embargo está el detalle de lo que significa en el entorno hispano la voluntad de mejorar la situación de estos jóvenes en el futuro inmediato y su potencial influencia política en el futuro. En todo caso no creo que valga la pena especular sino estar atentos a ver cómo es que se va a implementar la medida de alivio anunciada por la Secretaria Janet Napolitano. Otra importante noticia de inmigración, que tendrá también su impacto político, es que la Corte Suprema de Estados Unidos suavizó parcialmente la polémica ley de inmigración SB1070 de Arizona, al permitir que la policía le pregunte a detenidos si están legalmente en el país pero prohibiéndoles que arresten a inmigrantes indocumentados bajo cargos criminales por no tener papeles. Esto significa que los policías en Arizona, o cualquier estado que tenga una ley similar, podrán detener y verificar el estatus migratorio de los extranjeros pero no podrán imponerles cargos en caso de no tenerlo, como contemplaba originalmente la ley aprobada por la legislatura estatal en Arizona. Ahora tener cara de extranjero puede ser suficiente para ser objeto de que le exijan su estatus migratorio. ¿Cómo luce un extranjero en este país multicultural? Hace menos de un mes mi sobrina contrajo matrimonio en el estado de Texas con un muchacho norteamericano. Para la ocasión su madre, mi hermana, viajó desde Venezuela para asistir a la ceremonia. Para poder movilizarse rentó un auto, como hacen miles de turistas en este país, y como también muchos de ellos, pues manejó por encima de la velocidad autorizada. Un policía la detuvo y le pidió sus documentos. Todo normal hasta ese momento. Lo particular empezó cuando el representante de la ley le dijo, “usted esta manejando sin un permiso de conducir válido y su multa por esto es de 400 dólares”. Mi hermana trató de replicar y el policía tajantemente le dijo, “¡si sigue hablando va presa!” La cosa es que como turista, usted parte del principio de que con la licencia vigente de su país usted puede conducir legalmente durante su estadía, al menos así lo es, por ejemplo, en Delaware. Pero no es lo mismo en Texas, aparentemente. Pero sí le rentan el vehículo, lo cual resulta muy contradictorio ya que si no es legal manejar con la licencia de tu país, ¿cómo una empresa te involucra en una acción ilegal? ¿No es acaso obligación de la empresa alquilar sólo a quien tiene licencia válida? Este pequeño ejemplo me remite a la manera como los estados interpretarán de aquí en adelante la decisión de la Corte Suprema. Una decisión ésta que incluyó la impugnación de partes claves de la ley de Arizona. Por ejemplo, los magistrados eliminaron las cláusulas que exigían que todos los extranjeros lleven consigo papeles migratorios y que sea una acción criminal buscar trabajo sin tener papeles que autoricen empleo. El presidente Barack Obama expresó su preocupación diciendo, “Ningún estadounidense debe vivir bajo la sombra de la sospecha sólo por lo que parece ser”. En el otro lado de la moneda, la gobernadora de Arizona, Jan Brewer, calificó el dictamen de la corte como un triunfo. “Es una victoria para el imperio de la ley y también una victoria para todos los estadounidenses que creen en el derecho inherente y la responsabilidad de los estados de defender a sus ciudadanos”. Esta decisión es como si en un juego de beisbol, el hombre al bate bateara con las dos manos al mismo tiempo, si pero no, un poquito para ti un poquitopara él. Y ahora, ¿qué tan hispano, musulmán, japonés etc., luzco yo? ¿Debo mantener mis documentos conmigo todo el tiempo o puedo ser deportado incluso siendo ciudadano de este país? ¿Dónde quedará la libertad de movimiento? Muchas interrogantes y muchos votos que repartir.

The political importance of the immigrants in the United States is anything but new. Adventurers and traders of the vote implemented an accurate measure at the time of the great European migratory movement towards the United States during the second half of the 19th century. The brave Democrat militants of Mayor Fernando Wood of New York addressed each immigrant of legal age who landed at the port of the city offering them nationality immediately in exchange for their vote for the Mayor, who was seeking a second term of mandate. His boldness was such that members of the band “the dead rabbits” that supported him, toured cemeteries collecting names of “voters”. As history always teaches us, again in these times immigrants return to the political arena. Time of elections and the explicit will of the administration of Obama not to deport anymore young people who may qualify for the Dream Act, should be seen in that context. Of course, a question arises here and it is that how voting will be influenced, for example by the parents of those million children that could qualify for the Dream Act? At first glance, in any way because their parents are precisely undocumented and are far from being able to vote. However there is the detail of what it means in the Hispanic environment the desire to improve the situation of these young people in the immediate future and their potential political influence in the future In any case I do not think that it is worth to speculate about it but to be vigilant to see how the relief measure announced by Secretary Janet Napolitano will be implemented. Another important immigration news, which will also have its political impact, is that the United States Supreme Court partially softened the controversial Arizona SB1070 immigration law, to allow the police to ask detainees whether they are legally in the country but forbidding them to arrest undocumented immigrants under criminal charges for not having papers. This means that police in Arizona or any State which has a similar law, can stop and check the immigration status of foreigners but they may not impose charges in case of not having it, as it was originally stated in the law passed by the State legislature in Arizona. Now looking like a foreigner can be sufficient to be demanded to demonstrate ones immigration status. How does a foreigner in this multicultural country look like? Less than a month ago my niece married in the State of Texas with an young American boy. For the occasion, her mother, my sister, traveled from Venezuela to attend the ceremony. To be able to mobilize, she rented a car, as do thousands of tourists in this country, and also as many of them, well, she drove over the speed limit. A police officer stopped her and asked for her documents. All normal so far. The particularity began when told by the representative of the law, “you are driving without a valid driver’s license and your fine for this is $400.” My sister tried to replicate and the police flatly told her, “If you continue to speak, I will arrest you!” The thing is that as a tourist, you start from the premise that with the license in force in your country you can legally drive during your stay, and at least this is so, for example, in Delaware. But it is not the same in Texas, apparently. But they do rent you the vehicle, which is very contradictory because if it is not legal to drive with the license from your country, how does as a company get you involve in an illegal action? Isn’t it the rental company’s duty only to rent to those who have a valid license? This small example makes me think about the way the States will interpret the Supreme Court’s decision from now on. This was a decision that included contesting key parts of the Arizona law. For example, judges removed clauses requiring that all foreigners carry immigration papers with them at all times and declared that seeking work without papers authorizing employment is a criminal action. President Barack Obama expressed his concern saying, “No American should ever live under a cloud of suspicion just because of what they look like.” On the other side of the coin, the Governor of Arizona, Jan Brewer, described the ruling of the Court as a triumph. “It is a victory for the rule of law and also a victory for all Americans who believe in the inherent right and the responsibility of the States to defend their citizens.” This decision is as if in a game of baseball, the player at the plate bats with both hands at the same time, yes but no, a little bit for you a little bit for him. And now, how Hispanic, Muslim, Japanese etc., do I look? Do I have to keep my documents with me all the time, or can I be deported even though being a citizen of this country? Where will the freedom of movement stand? Many questions and many votes to be distributed.

Alivio contra la Deportación
La Secretaria Napolitano anunció proceso de acción diferida para Jóvenes de baja prioridad para la aplicación de la Ley.
El anuncio llega después de una intensa discusión política y debate nacional que ha visto el surgimiento de los activistas llamados los Dreamers como líderes en la agenda política, como es el caso de Delaware según se refleja en las páginas de este periódico de los últimos meses. Lili G, resume lo que sintió al escuchar el anuncio de la Secretaria Napolitano en una sola palabra: alivio. “Nos han dejado esperando por tanto tiempo, que lo primero que uno piensa es que nos han mostrado nuevamente un caramelo para que se nos agüe la boca, pero nada pasa,” comentó Lili, quien es madre de un joven estudiante indocumentado que llegó con ella con 13 años y hoy en día esta becado en la universidad con notas excelentes. “Siento un gran alivio por que ahora mi hijo va a poder tener un permiso de trabajo y quizas aplicar para la ciudadanía, gracias a Dios.” La Secretaria de Seguridad Nacional, Janet Napolitano, anunció el 15 de junio que con vigencia inmediata, ciertos jóvenes que entraron en los Estados Unidos siendo niños, que no presentan un riesgo para la seguridad nacional ni para la seguridad pública y que cumplen con varios criterios clave serán considerados para recibir alivio contra la deportación o contra el inicio del proceso de deportación. Aquéllos que demuestren que cumplen con los criterios serán elegibles para recibir la acción diferida durante un período de dos años, sujeto a renovación, y serán elegibles para solicitar la autorización de empleo. “Las leyes de inmigración de nuestro país deben hacerse cumplir de una manera firme y sensata”, comentó la Secretaria Napolitano. “Pero no están diseñadas para hacerse cumplir ciegamente sin tener en cuenta las circunstancias individuales de cada caso. Ni están diseñadas para deportar a jóvenes productivos a países donde puede que no hayan vivido nunca o que ni siquiera hablen el idioma. En estos casos, la discreción, la cual se utiliza en tantas otras áreas, está especialmente justificada”. Bajo esta directiva, los individuos que demuestren que cumplen con los siguientes criterios serán elegibles para el ejercicio de la discreción, específicamente la acción diferida, considerado caso por caso: 1. Vino a los Estados Unidos siendo menor de dieciséis años de edad; 2. Ha residido ininterrumpidamente en los Estados Unidos durante al menos cinco años antes de la fecha de este memorándum y está presente en los Estados Unidos en la fecha de este memorándum; 3. Está asistiendo actualmente a la escuela, se ha graduado de la enseñanza secundaria, ha obtenido un certificado de desarrollo de educación general, o es un veterano que ha sido dado de alta con honores de los Guardacostas o las Fuerzas Armadas de los Estados Unidos; 4.) no ha sido condenado por un delito mayor, un delito menor significativo, múltiples delitos menores ni representa una amenaza para la seguridad nacional o la seguridad pública; 5. No es mayor de treinta años de edad. Sólo aquellos individuos que puedan demostrar mediante documentación verificable que cumplen con estos criterios serán elegibles para la acción diferida. Los individuos no serán elegibles si no se encuentran actualmente en los Estados Unidos y no pueden probar que han estado presentes físicamente en los Estados Unidos durante un período no inferior a 5 años inmediatamente anterior a la fecha de hoy. Las solicitudes de acción diferida se decidirán individualmente caso por caso. El DHS no puede dar ninguna garantía de que dichas solicitudes sean concedidas. El uso de la discreción procesal no otorga ningún derecho fundamental, estatus migratorio ni camino hacia la ciudadanía. Solo el Congreso, actuando a través de su autoridad legislativa, puede otorgar estos derechos. Aunque esta guía entra en vigor inmediatamente, se espera que USCIS e ICE comiencen la implementación del proceso de solicitud en un plazo de sesenta días. Deportation Relief
Secretary Napolitano announces deferred action process for young people who are low enforcement priorities
Secretary of Homeland Security Janet Napolitano announced on June 15th. that effective immediately, certain young people who were brought to the United States as young children, do not present a risk to national security or public safety, and meet several key criteria will be considered for relief from removal from the country or from entering into removal proceedings. Those who demonstrate that they meet the criteria will be eligible to receive deferred action for a period of two years, subject to renewal, and will be eligible to apply for work authorization. “Our nation’s immigration laws must be enforced in a firm and sensible manner,” said Secretary Napolitano. “But they are not designed to be blindly enforced without consideration given to the individual circumstances of each case. Nor are they designed to remove productive young people to countries where they may not have lived or even speak the language. Discretion, which is used in so many other areas, is especially justified here.” DHS continues to focus its enforcement resources on the removal of individuals who pose a national security or public safety risk, including immigrants convicted of crimes, violent criminals, felons, and repeat immigration law offenders. Today’s action further enhances the Department’s ability to focus on these priority removals. Under this directive, individuals who demonstrate that they meet the following criteria will be eligible for an exercise of discretion, specifically deferred action, on a case-by-case basis: 1.) Came to the United States under the age of sixteen; 2.) Have continuously resided in the United States for a least five years preceding the date of this memorandum and are present in the United States on the date of this memorandum; 3.) Are currently in school, have graduated from high school, have obtained a general education development certificate, or are honorably discharged veterans of the Coast Guard or Armed Forces of the United States; 4.) Have not been convicted of a felony offense, a significant misdemeanor offense, multiple misdemeanor offenses, or otherwise pose a threat to national security or public safety; 5.) Are between the ages of 15 and 30 (as of June 15, 2012) Only those individuals who can prove through verifiable documentation that they meet these criteria will be eligible for deferred action. Individuals will not be eligible if they are not currently in the United States and cannot prove that they have been physically present in the United States for a period of not less than 5 years immediately preceding today’s date. Deferred action requests are decided on a case-by-case basis. DHS cannot provide any assurance that all such requests will be granted. The use of prosecutorial discretion confers no substantive right, immigration status, or pathway to citizenship. Only the Congress, acting through its legislative authority, can confer these rights. While this guidance takes effect immediately, USCIS and ICE expect to begin implementation of the application processes within sixty days. In the meantime, individuals seeking more information on the new policy should visit USCIS’s website (at www.uscis.gov), ICE’s website (at www.ice.gov), or DHS’s website (at www.dhs.gov). Beginning Monday, individuals can also call USCIS’ hotline at 1-800-375-5283 or ICE’s hotline at 1-888-351-4024 during business hours with questions or to request more information on the forthcoming process. For individuals who are in removal proceedings and have already been identified as meeting the eligibility criteria and have been offered an exercise of discretion as part of ICE’s ongoing case-by-case review, ICE will immediately begin to offer them deferred action for a period of two years, subject to renewal. In the meantime, potential applicants should NOT attempt to file applications or to pay any attorney or individual to assist them in preparing an application. No application process has been announced yet and no applications will be accepted until that process is in place. Applicants should beware of scam artists who promise to “help” with immigration applications. Always visit USCIS.gov or other legitimate government sources of immigration information. Do not file papers, pay money, or provide identity or other information to “immigration helpers,” notarios, or others who claim they can assist with an application.

G.: “Creo que cada vez que hay elecciones el tema del Dream Act viene al caso, como hace dos años cuando estuvimos un diciembre esperando la gran noticia y todo se vino abajo; porque como siempre, Demócratas y Republicanos no se ponen de acuerdo. Creo que el voto latino es muy importante, y aunque ellos no lo admiten públicamente, estos dos partidos se quieren llevar este punto a favor, de ahí que cuando Republicanos quieren ayudar, los Demócratas no, como años atrás cuando Bush lo planteaba. En fin, estamos como siempre en medio de la pelea. Dios quiera que esta sea la vencida. Estoy cansada que jueguen con los sentimientos nuestros, pero en especial con los de nuestros hijos. Pienso que ahora Obama puso en jaque a Romney, vamos a ver cómo salen ambos de ésta y vamos a ver si se acaba esta esclavitud del siglo XXI, porque trabajamos duro, damos lo mejor de nosotros y nos castigan limitando los sueños de nuestros hijos. Mis preguntas son: ¿Quién dará el Jaque Mate? ¿Saldremos beneficiados? Dos años se van rápido. ¿Habrá alguna mala jugada para entonces?” Laura l. G.: “I think that every time there is an election, the Dream Act issue arises, as it was the case two years ago, when we were waiting in December for the big news and everything tumbled down because, as always, Democrats and Republicans were not able to reach an agreement. I think that the Latino vote is very important and even though they do not admit it publicly, these two parties want to score this point in favor, hence, when Republicans want to help, Democrats will not, like years ago when Bush raised the issue. In short, we are as always in the middle of the fight, may God have this one to be the winning one. I am tired of people playing with our feelings, but especially with those of our children. I think that now Obama has Romney against the ropes, let’s see how they finish up here, and let’s see if this 21st century slavery can be abolished, because we work hard and give the best of ourselves, but we are punished by limiting the dreams of our children. What I wonder is: who will deliver checkmate? Will we be benefited? Two years go fast. Hace un par de semanas el presidente Barack Obama anunció que su gobierno suspenderá la deportación (“acción diferida”) de jóvenes elegibles para el DREAM act y les autorizará permisos de trabajo, con efecto inmediato. Estos muchachos, quienes fueron traídos a los Estados Unidos cuando eran muy jóvenes, han vivido en el limbo mientras el Congreso ha jugado un fútbol político con sus vidas, al no aprobar el DREAM act y darles un camino hacia la legalización. Aunque la acción del presidente no puede concederles un estatus legal permanente, es un importante paso que les dará tranquilidad y la posibilidad de trabajar aun gran cantidad de personas. El anuncio del presidente planteó varias cuestiones; por eso, ofrecemos un poco de claridad por medio de los seis datos que necesitas saber sobre de la acción diferida y los estudiantes del DREAM Act: 1. ¿Tiene el presidente la autoridad para hacer esto? 6 Things You Need to Know About Deferred Action and DREAM Act Students
President Obama Takes Important Step to Help Immigrant Youth
By The Center for American Progress Immigration Team Three weeks ago, President Barack Obama announced that his administration will suspend deportation (“deferred action”) and grant work authorization to DREAM Act-eligible youth, effective immediately. These youth, who were brought to the United States at a young age, have been living in limbo as Congress plays political football with their lives by failing to pass the DREAM Act and give them a pathway to legal status. Though the president’s action cannot grant permanent legal status, it is a significant step forward that will give piece of mind and the ability to work to a significant group of people. The president’s announcement raised some questions, so we offer some clarity below by listing six things that you need to know about deferred action and DREAM Act students: 1. Does the president have the authority to do this? Yes. Deferred action is a type of prosecutorial discretion available to the president as part of routine immigration law. It allows the president to stop or suspend the deportation of an individual and to grant that person work authorization. Presidents from both parties have used deferred action frequently since 1971. 2. Who is eligible for deferred action? Similar to the provisions of the House-passed version of the DREAM Act in 2010, anyone who came to the United States before age 16, and is over age 14 and under age 31 on June 15, 2012, is eligible if they have been in the United States for at least five years, are in or have completed high school, are in the armed services currently or have been honorably discharged, and have not been convicted of a felony, significant misdemeanor, or multiple misdemeanors. Individuals under 15 years old who are in, or get placed in removal proceedings, are also eligible to apply. 3. How many people are eligible? Up to 1.4 million people will qualify. DREAMers not already known to the Department of Homeland Security will be able to come forward and apply for the deferred action. 4. Isn’t this amnesty? Absolutely not. Deferred action is only a temporary two-year status; it is not permanent residency. It isn’t a reward for anything, and it does not allow any immigrant to bring over their family members. Further, it does not bring a single extra person into the United States. These youth already live here. DREAMers will be able to apply for this status, and it will be decided on a case-by-case basis. This is not a blanket form of relief. 5. Will this policy encourage more illegal immigration? No. This policy is neither a magnet for undocumented immigration nor a long-term solution to the problem. Only individuals who have been in the country for five years before today are eligible to apply for this temporary protection. It merely allows qualifying individuals to stop looking over their shoulder and start looking toward their future until Congress can overcome its paralysis. 6. Do we still need Congress to pass the DREAM Act? Yes! The president’s announcement gives only temporary legal status to DREAM Act-eligible youth, and it can be revoked with the stroke of a pen by the next president. Only Congress can pass a law—the DREAM Act—to protect these students permanently and give them a pathway to citizenship.

‘Un Punto de Vista’ ‘A Matter Of View’

Nada como un buen libro
El verano comenzó oficialmente y la cosa está que arde, literal y metafóricamente hablando. Parecería que tan pronto llegó el 20 de junio, también llegó el calor, la humedad y el clima pesado. Pero yo no estaba hablando de ese tipo de calor, al que me estoy refiriendo es el tipo de calor que está provocando el libro “Fifty Shades of Grey” (Cincuenta tonos de gris) de la autora británica E.L. James. Quién hubiera pensado que este libro ha sido prohibido en muchas bibliotecas y ventas de libros porque se le considera como pornografía, ¿en serio? Realmente no puedo comprender ese concepto en este país. Vamos a estar claros que es un libro erótico, lleno de contenido muy explícito y sensual, pero sin embargo, realmente atrapa al lector, especialmente a las mujeres. Para mi cumpleaños número 50, mi hijo me regaló un lector electrónico de libros Kindle Fire y mi primera compra y descarga en el lector fue la trilogía de “Fifty Shades of Grey” (Cincuenta tonos de gris), “Fifty Shades Darker” (Cincuenta tonos más oscuros) y “Fifty Shades Freed” (Cincuenta tonos más liberada). Confieso sin vergüenza alguna que estoy enganchada con esta trilogía y sus personajes. Las historias en estos libros es contada a través de la voz y los ojos de Anastasia Steele, quien es una estudiante de postgrado muy joven que accede a someterse al estilo de vida de Christian Grey de sadomasoquismo o esclavitud y disciplina debido a su amor por él. Es un tipo de libro de fácil lectura, no es una obra maestro de literatura, de ninguna manera, pero Erika Leonard, el verdadero nombre de la autora, ha transformado esta historia de amor ficticia en un éxito en ventas. ¿Es pornografía? No estoy de acuerdo con esta etiqueta, quizás es erótico, pero permítanme confesarles que ésta es la primera vez en mi vida que leo este tipo de libros, y estoy fascinada. Se ha dicho que a Angelina Jolie le gustaría dirigir la versión cinematográfica de este libro y que al autor Bret Easton Ellis de “American Psycho” le gustaría escribir el libreto. En mi opinión, una película basada en estos libros sería muy, pero muy difícil de crear sin que pareciera que son películas censuradas. No sé si me gustaría verlos transformados en películas, pero pensándolo bien ¿quién soy yo para opinar? Por muchos meses he visto en televisión y leído en Internet acerca de esta trilogía de libros y la polémica que han ocasionado. Pero curiosamente, publiqué en mi estatus de Facebook que estaba leyendo “Fifty Shades of Grey” y la respuesta que obtuve de amigos(as) que lo han leído fue positiva. Una de ellas publicó “Yo le compré a mi esposo una corbata gris… digo yo”. Pensé que era interesante cómo este libro ha capturado la atención y la imaginación de mujeres de todas las edades, razas y profesiones alrededor de todo el mundo. Pero no se dejen llevar por mi opinión, simplemente léanlo y fórmense su propio juicio. Me sorprendió el hecho de que me terminara gustando leer estos libros, no los podía soltar. Hay algo que sí sé por seguro, y es que no hay nada como un buen libro. ¡Disfruten la lectura, pues!

“Nothing Like a Good Book”
Summer is officially here and the heat is on, literally and figuratively. It seems that as soon as June 20th came, so did the hot, humid and muggy weather. But I was not talking about that kind of heat, the one I am referring to, is the kind of heat that is and has been causing the book “Fifty Shades of Grey” by British author, E. L. James. Who would have thought that this book has been prohibited in many libraries and sales bookstores because is viewed as porn, really? I truly don’t understand or fathom that concept in this country. Let me be clear that it is an erotic book, filled with very explicit and steamy content, but nevertheless, it truly grabs the reader, especially females. For my 50th birthday, my son gifted me with a Kindle Fire and my first purchase and download was the trilogy of “Fifty Shades of Grey”, “Fifty Shades Darker” and “Fifty Shades Freed.” I confess without any shame that I am hooked with this trilogy and its characters. The stories in these books unfold by the voice and eyes of Anastasia Steele, who is a very young college graduate student that agrees to submit into Christian Grey’s lifestyle of S&M or bondage and discipline due to her love for him. It is a very easy to read type book, not a literary masterpiece, by no means, but Erika Leonard, author’s true name, has created this fiction love story into a great best-selling success. Is it porn? I don’t agree with that label, maybe erotica, but let me disclose that this is the very first time in my life that I read this type of books and I am taken. It has been reported that Angelina Jolie would like to direct this book into a movie and that author Bret Easton Ellis of “American Psycho” would like to write the screenplay. A movie of these books in my opinion would be very, very difficult to create without not making them look like they are triple X movies. I don’t know if I would like to see it made as a movie, but then again, who am I? For many months, I have seen on television and read online about this trilogy of books and how controversial they have become. But funny enough, I posted on my Facebook status that I was reading “Fifty Shades of Grey” and the reply from friends that have read it was a positive response. One of them posted “I bought my husband a grey tie…just saying!” I thought it was interesting how this book has captured the attention and imagination of women of all ages, races, and professions from all over the world. Don’t take my word for it, just read it and make your own judgment. I know that I was surprised of how much I ended up liking reading the books, I couldn’t put them down. Something I know for sure, and that is that there is nothing like a good book. Happy readings!

CreAtiNG A GeNerAtiON Of reADers Across the country, some lucky students just learned that their school’s library was selected by Target for a School Library Makeover. At 32 different schools, students will see their libraries renovated, updated, and outfitted with new computers, iPads, and thousands of new books. The students will be excited, of course, thanks to the new technology and new books. But they’ll also be hopeful and proud -- as the upgraded library will demonstrate that the community is committed to investing in their success. These upgrades are part of a larger effort by Target to invest $1 billion for education by the end of 2015. The School Library Makeover program will help improve reading proficiency by transforming libraries at 32 elementary schools around the country which serve predominantly low-income students. It’s a small but much needed step to help turn the tide against a growing crisis in our nation’s education system. At a time when the economy continues to shift towards knowledge-based jobs, and when reading skills have never been more important, the country is often failing to give children the skills they need to succeed. Young people will be seeking jobs in a market where 75 percent of openings require not just a high school diploma, but also some post-secondary education. Recent studies have found that developing reading skills early on has a significant impact on future educational success. Third grade, it turns out, is a critical juncture when it comes to reading. That’s when children shift from learning to read to reading to learn. And students who can read at grade level when they start the fourth grade are far more likely to graduate from high school than those who can’t, according to research sponsored by the Annie E. Casey Foundation. In fact, children who lack basic reading skills by the fourth grade are about four times more likely to fail to get a high school diploma than those who are proficient readers. Despite the high stakes, an alarming number of fourth graders can’t read at grade level. According to the Department of Education, just 34 percent of fourth graders rank as proficient readers. Among low-income students, that number is an even more distressing 27 percent. Is it any wonder that one in four children doesn’t graduate from high school on time, if ever? The odds are even worse for Hispanic and African American students, with 40 percent failing to get a diploma. One of the best ways to give these students a chance is to help them become successful readers. School libraries provide students with the books, resources, and mentors they need to succeed. In Florida, for example, elementary schools that had library programs staffed 60 hours a week or more showed a 9 percent improvement in test scores compared to those staffed less than 60 hours. A study of Alaska schools found that students in schools with full-time librarians scored higher on standardized achievement tests than those with part-time or no librarians. Unfortunately, school libraries are increasingly targeted for budget cuts. Overall, school library budgets have fallen since 2009. And cutbacks tend to be more severe at schools serving high-poverty areas. Local and state officials must make literacy programs a high priority in budget plans and strategies. Against this backdrop, programs like Target’s can help schools overcome difficult fiscal times -- and get students reading during those critical early years. The makeovers leverage the pro bono work of Target’s design and construction teams, along with the support of thousands of Target team member volunteers. And it happens with a partnership from The Heart of America Foundation. In each school selected for a library makeover, Target has also partnered with Feeding America to create a “Meals for Minds” food pantry, which helps children concentrate and perform better in school by providing much-needed nourishment. The students also take home seven books of their own, as studies have demonstrated that reading at home has a dramatic impact on educational success. But as much as the new libraries complement the physical classroom, the country’s education crisis won’t be solved until everyone at every level - including parents, school administrators, local, state and federal government officials, and other caring adults - recognizes that future generations deserve the resources needed to improve reading skills when it really counts. Now that we know where to focus our efforts, the time for collective action is now. Today’s students deserve nothing less. That’s what the Governor’s gambling expansion bill, HB333, will do. Anyone with internet access and a credit card will have instant access. There is NO sure way to block adolescent gambling. It’s a fact that when there’s an increase in gambling, there’s in an increase in crime, addiction, family devastation and fragmentation. Before the vote in the House, it was asked if the same percentage of funding would be given to state funded gambling addiction programs. The answer was “yes” as in, “Here is help, AFTER one has devastated their family and gambled away their futures, and that’s IF one even asks for help.” It is believed that the three horse tracks/casinos in Delaware will have to lay people off due to the decline in revenues as a result of increased gambling venues in others states. Lawmakers who campaigned on saving and bringing more jobs may feel compromised by this bill which bundles relief for the tracks together with the most invasive gambling expansion we’ve ever seen. It’s a slippery slope - where does it stop? If jobs are that critical, then give the tracks tax relief, but not this tremendous home invasion gambling bill! For the sake of Delaware’s increasing rate of family fragmentation, please find a better way. We expect our politicians to look for stable sources of revenue that aren’t going to increase crime, erode the family and, ultimately, expand government social services to address all the ills that come with gambling. Please call your Senator today, the vote is this week, and urge them to vote NO on HB 333, the Governor’s “Anytime, Anywhere, Home Invasion Gambling” bill. Management & Training Corporation (MTC) has named April Aguilera Outreach & Admissions/Career Transition Services (OA/CTS) Educator of the Year for her commitment to excellence. Ms. Aguilera is the OA/CTS administrative assistant at the Wilmington Job Corps Center. She joined MTC in 2010. This top honor is part of MTC’s Annual Celebrating Excellence program, where employees, Job Corps students, and community members are recognized for their achievements with awards, scholarships, and cash prizes. Hace catorce años, durante la apertura del primer restaurante de Matt Haley en Bethesda, MD, él sorprendió a su personal cuando decidió irse temprano. Anywhere, Anytime, Anything
Successful restaurateur lives to give back

Fourteen years ago at the opening of Matt Haley’s first restaurant in Bethesda, Md., he shocked his staff when he chose to leave early. He didn’t tell them why; they just knew he’d be gone by 6 p.m. As a new business owner, some thought he was crazy. His investors, he said, were not too happy. But Haley had another commitment that night. He had promised a young man he would speak on his behalf at a local Twelve-Step Program. Nowadays, Haley still holds strong that commitment to the community. He’s opened seven restaurants in and around the Delaware beaches since then, along with a catering company and a restaurant management business, but he never forgets to pay it forward. One of his earliest inspirations came from his mother, who always was willing to lend a helping hand to anyone who needed it. Looking back, he realizes she was his first role model for the philanthropic life he now leads. “She was always there for someone and the door was always open,” he recalls. “It was neat seeing her do some of the stuff that she did.” As a single mother raising five children, she helped out other single parents by running a daycare, giving parents an opportunity to work. The family didn’t have much, so little in fact that Haley’s mother often dressed in her children’s clothing. But she always put aside her own struggles to make time for others. She would spend several hours sometimes listening to the moms who were picking up their kids vent about life. Her natural selflessness had a huge impact on Haley and his siblings, who have spent their lives building on the charitable gene they inherited. Inspired by his mother and many other life hurdles and blessings, Haley lives by the mantra “anywhere, anytime and anything.” The array of causes in which he is involved is a perfect example of him living true to that motto. From spending time with local foster children to helping individuals dealing with addiction to speaking about health at a local elementary school, Haley always is willing to help. A few years ago, he established the Global Delaware Fund, a nonprofit organization that provides necessities, such as clothing, shelter and food, as well as healthcare and educational services, to children in need both locally and throughout the world. The organization has helped establish and sustain schools as far away as India. Locally, the Fund works with groups like Delaware’s foster children, the Food Bank of Delaware and Rehoboth Summer Children’s Theatre. Haley travels frequently throughout the year, often to Nepal, where he has helped establish schools for children who normally wouldn’t have the opportunity to become educated. Many, in fact, are orphans. When Haley travels to these destinations, he doesn’t take the typical tourist route. “Wherever I go, I stay connected to the environment that I am in,” he says. “I’ll find a children’s home or an orphanage somewhere that I have to connect with. I feel like I owe it to that community that has opened its arms up to me to allow me to travel there.” Haley recalls a recent trip to Marrakech, Morocco, where he was traveling with a local who was excited to show him an attraction many enjoy when visiting. “It was this fancy art garden thing, and it was great,” he said. “I saw it and I said, ‘Alright, now take me to the worst part of town. Find me an orphanage where there are kids.’” And he did. Haley continues to communicate with that orphanage and all others he’s touched, as a big part of the mission of the Global Delaware Fund is to keep support and communication consistent. “We believe that wherever we touch, we need to go back,” he said. Haley is adamant about why he gives back; he sees it not as helping others, but as helping himself. He was taught that if he ever was having a bad day, he should go out and help someone else, an act he still practices today. The ability to give exists in everyone, he says. “It’s just being involved, on whatever level. It’s in everybody. Most people are just afraid of it. Whether it’s putting on a T-shirt and building a house for Habitat (for Humanity) or just smiling at someone while you’re walking down the street.” When not helping strangers, Haley enjoys working with the younger employees in his restaurants who show an interest in the culinary arts. “I’d rather work with a young guy in the kitchen,” says Haley, who owns Northeast Seafood Kitchen in Ocean View, Fish On! in Lewes, Bluecoast Seafood Grill in Bethany Beach, Catch 54 in Fendwick Island, Lupo Di Mare in Rehoboth Beach, Betty’s Classic American in Lewes, Matt’s Fish Camp in North Bethany and Plate Catering. “I love taking the time to teach them things. I used to take the bus to work 15, 16 years ago, making seven bucks an hour, and now I have the ability to have an impact on a guy who was probably heading in the same direction I was. I dig that. After dedicating so much time to others, it’s difficult to keep track of all the organizations and causes Haley has touched. That number doesn’t matter to him, though. “It’s not about what I’m involved in; it’s why I’m involved,” he says. Fourteen years have passed since Matt Haley showed true generosity of heart on one of the most important nights of his life. That spirit has proven to only grow stronger with time. Educación Prenatal
A Nanticoke Memorial Hospital le ha sido otorgado un subsidio por un poco más de $97.000 de parte del programa Anteproyecto para la Comunidad de Blue Cross Blue Shield.
Este subsidio ha sido otorgado para ayudar a Nanticoke a difundir la educación prenatal entre la población hispana del área. La enfermera Marisela Serna quien cuenta con 19 años de experiencia con el hospital de Nanticoke, explica que ya durante tres años han venido trabajando en colaboración con el centro de salud La Red en Georgetown por 12 horas a la semana educando a las madres embarazadas sobre la importancia de una buena alimentación durante el embarazo, así como los cuidados durante y después del parto. El programa actual de Nanticoke incluye educación en nutrición prenatal para reducir el riesgo de una mujer a contraer diabetes gestacional. El subsidio que recibieron les permitirá enfocarse más en la diabetes gestacional y la prevención de la obesidad en los niños, dice Serna. Prenatal Education
Nanticoke Memorial Hospital has received a grant for a little over $97,000 from the Blue Cross Blue Shield Blueprints for the Community program.
This grant has been received to help Nanticoke expand prenatal education among the Hispanic population in our area. Nurse Marisela Serna, who has been with Nanticoke Hospital for 19 years, explains that for the past three years they have been working in collaboration with La Red health center in Georgetown for 12 hours per week educating pregnant women about the importance of eating right during pregnancy, as well as about care during and after delivery. Nanticoke’s current program includes education on prenatal nutrition to reduce a women’s chance of developing gestational diabetes. The grant they have received will allow them to focus more on gestational diabetes and child obesity prevention, says Serna. Expansion of the program allows us to offer education for women that have developed gestational diabetes with a focus on teaching them to manage their gestational diabetes to prevent complications during their pregnancy. Our initiative also teaches mothers early childhood nutrition to ensure that their children are less likely to develop diabetes and less likely to become obese. The program is available in La Red Helath Center on Tuesdays, Thursdays and Fridays, although it is also possible to coordinate workshops in other organizations. Please call Marisela Serna at 302-245-1899. According to the American Diabetes Association, Hispanics are twice as likely as Caucasian Americans to develop diabetes. This grant will help us expand both the availability and the number of educational services provided by this program to better meet the population need. The ultimate goal is to expand our Hispanic outreach program in order to improve access to health care for the uninsured/underserved Hispanic population and reduce nutritional health disparities in the Hispanic communities we serve. According to the data gathered, they expect to diagnose 70 patients with gestational diabetes in Sussex’s Hispanic community during the course of next year, that’s why Nancy Oyerly director of the Mother Baby Care Center in Nanticoke said, “We really want to outreach the Hispanic population in general, but specifically we want them to be more prepared of what they can expect and help them to understand the impact of nutrition on pregnancy and their children and prevent the diabetes in their children in the future. We believe this initiative is vital for the communities we serve and will save lives of babies in Sussex County.”

Filetes de pollo a la crema de yogur
Ingredientes: 8 filetes de pechuga 150 grs. de cebolla troceada 1 vasito de vino blanco 30 grs. de mantequilla 200 ml de yogur natural 3 cucharadas de mostaza a la pimienta verde 3 yemas de huevo Aceite de oliva, sal y pimienta Preparación: 1. Colocar las pechugas congeladas dentro de una bandeja honda cubiertas de leche dentro del frigorífico para que se descongelen lentamente, y la cebolla dentro de una escurridora para que al descongelarse elimine toda el agua. 2. AI día siguiente, poner una cazuela al fuego con la mantequilla y un poco de aceite. Sofreir las pechugas previamente escurridas y salpimentadas. En cuanto cambien de color, se añade la cebolla descongelada y escurrida y se deja a fuego lento removiendo de vez en cuando. 3. A media cocción, agregar el vino, y mientras cuece el pollo, preparar la salsa colocando el yogur y las yemas dentro de una olla al baño maría sin dejar que hierva. Batir la mezcla hasta que empiece a espesar o se forme en la superficie un poco de espuma. 4. Añadir la mostaza y seguir batiendo hasta que la salsa espese, añadiendo por último la salsa de la cocción previamente pasada por el colador chino. Seguir removiendo fuera del fuego para formar una salsa ligada. Servir las pechugas cubiertas con la salsa, acompañadas de unos bocaditos de papa o un flan de arroz.

Place the frozen chicken breasts in a deep dish covered with milk. Then put the dish in the fridge so that the chicken defrosts slowly. Put the onion in a strainer so that as it defrost, all the water drips away. 2. The next day, put a saucepan on the heat with the butter and a little oil. Strain, add salt and pepper to the chicken breasts and then lightly fry. As soon as they change colour, add the defrosted and strained onion and leave over a low heat stirring from time to time. 3. When half-cooked, add the wine and while the chicken is cooking, prepare the sauce by putting the yogurt and the egg yolks in a saucepan bain-marie without letting it boil. Beat the mixture until it begins to thicken or a little froth forms on the surface. 4. Add the mustard and continue beating the mixture until the sauce thickens, adding at the end, the previously cooked and sieved sauce. Continue to stir off the heat to make a light sauce. Serve the chicken breasts covered with the sauce and accompanied by some potato morsels or a rice cake.

Alimentos saludables: la elección asequible

Pero muchas personas de escasos recursos, incluyendo aquellas bajo el programa de asistencia nutricional del USDA, se preguntan si pueden permitirse comprar alimentos saludables como los maravillosos y frescos productos agrícolas que pueden encontrarse en abundancia en el verano en los mercados de agricultores de los Estados Unidos. Healthy Foods: The Affordable Choice
By USDA Undersecretary Kevin Concannon Fresh fruits and vegetables? Key elements of a healthy diet, for sure. But many people of modest means, including those served by USDA’s nutrition assistance programs, wonder if they can afford to buy healthy foods like the wonderful fresh produce that can be found in summer abundance at America’s farmers’ markets. As USDA Undersecretary for Food, Nutrition and Consumer Services, I find that perception a source of concern because we work hard to encourage all Americans to make healthy food choices – particularly those participating in USDA’s nutrition assistance programs, from kids in school to the more than 46 million people participating in USDA’s Supplemental Nutrition Assistance Program. Well, I’m pleased to say that a recent study by USDA’s Economic Research Service, “Are Healthy Foods Really More Expensive? It Depends on How You Measure the Price,” found that healthy food choices, like fresh fruits and vegetables, may be more affordable than people think. They found that while it is easy to buy “cheap” calories by using less-healthy foods, there are many healthy food choices that cost no more per portion than less nutritious foods. Measured by the cost per portion, or per pound, grains, vegetables, fruit, and dairy foods are actually less expensive than most protein foods and foods high in saturated fat, added sugars, and/or sodium. This is great news for all those trying to get by with a limited food budget – like people receiving SNAP benefits. You don’t have to compromise on good nutrition just because money is tight. And just in time for summer. If you haven’t been to one of the nearly 7,200 farmers’ markets across the country, I encourage you to do so. Farmers’ markets offer shoppers a wonderful place to find the fresh fruits and vegetables and other local produce so important to a healthy diet – particularly now when farmers’ markets are practically bursting with a bounty of summer produce. USDA strongly supports farmers’ markets. And the Food and Nutrition Service, which I oversee, has farmers’ market programs for Supplemental Nutrition Assistance Program (SNAP) participants, for seniors, and for WIC mothers to help provide healthy food for them and their children. We also encourage farmers markets to accept SNAP electronic benefit transfer (EBT) cards, which makes it easier for SNAP participants to make purchases. Farmers markets are the ultimate win-win situation. They’re a win for customers because they can easily buy the freshest produce available. They’re a win for producers because they are a convenient local market for their products. They also provide a chance for customers and producers to meet face to face and build better understanding of community agriculture and what customers want. So visit a local farmers’ market today – you’re in for a treat. And remember, fresh fruits and vegetables are not only the healthy choice – they’re the affordable choice, too.

La obesidad en los niños latinos es un problema creciente.

Por Erick Recinos, experto en salud y nutricionista certificado El sobrepeso y la obesidad se extienden como una epidemia en la comunidad latina de los Estados Unidos. Según el último informe de la Asociación Médica Americana, la obesidad es un 40% más alta entre los hispanos que entre los blancos no hispanos entre las edades de 2 y 19. Las complicaciones a corto plazo de la obesidad incluyen las alteraciones ortopédicas, y las psicológicas, ya que los niños se sienten rechazados por los compañeros. Pero las consecuencias más graves no se ponen de manifiesto hasta la vida adulta, cuando aumentan el riesgo de diabetes y de complicaciones cardiovasculares. La buena alimentación constituye una combinación entre la comida natural, como los vegetales y las verduras, y los productos empaquetados bajos en azúcar, sodio y calorías. No es difícil hacerlo, el truco está en escoger comida saludable a la hora de la compra. Por ejemplo, las bebidas son unos de los productos que más dañan la salud si no se escogen conscientemente. La mayoría de las bebidas contienen calorías vacías cargadas de azúcar, y peor aún, cargadas de jarabe de maíz alto en fructosa (HFCS), un ingrediente artificial que contribuye al desarrollo de la obesidad y la diabetes, especialmente en los niños. Los jugos, entonces, hay que escogerlos con estos puntos en mente: naturales, altos en nutrientes, bajos en azúcar y calorías y sin ingredientes artificiales, incluyendo jarabe de maíz alto en fructosa. Si tomamos estos hábitos de comportamiento y cambiamos los hábitos dietéticos y de ejercicio de toda la familia, los niños se sentirán motivados y podrán pelear contra esta epidemia maligna que afecta a la comunidad Latina.

By Erick Recinos, expert in health and certified nutritionist Overweight and obesity are spreading like an epidemic in the Latino community of the United States. According to the latest report of the American Medical Association, obesity is 40% higher among Hispanics than non-Hispanic whites between the ages of 2 and 19. Short term obesity complications include orthopedic disorders as well as psychological, for children feel rejected by peers. But the most serious consequences are not revealed until adulthood, when they increase the risk of diabetes and cardiovascular complications. Good food is a mixture of natural food, such as vegetables and greens, and packaged products low in sugar, sodium and calories. It is not difficult to do so; the trick is to choose healthy foods at the time of purchase. For example, beverages are some of the products most harmful for your health if they are not consciously chosen. Most beverages contain empty calories charged with sugar, and yet worse, loaded with corn syrup high in fructose (HFCS), an artificial ingredient that contributes to the development of obesity and diabetes, especially in children. The juices are to be chosen then with these points in mind: natural, high in nutrients, low in sugar and calories and with no artificial ingredients, including high fructose corn syrup. Separando el mito de la verdad sobre el crédito tributario por hijo
Los ataques contra el Child Tax Credit sugieren que la compasión conservadora ha muerto
Por Marshall Fitz , Sarah Jane Glynn Vuelven a ser noticia los inmigrantes y el crédito tributario por hijo, que es el crédito rembolsable aprobado por el Congreso en 1998 para impedir que los niños caigan en la pobreza. En esta ocasión, las afirmaciones que se están haciendo son aun más exageradas y engañosas que antes. Recientemente, los Senadores David Vitter (R-LA) y Marco Rubio (R-FL) presentaron leyes por separado que tienen por objeto limitar la elegibilidad al crédito fiscal y están politizando el tema de forma activa a la vez que presionan por el voto en el Senado. Supuestamente, estos proyectos de ley pretenden impedir que las personas indocumentadas reciban el crédito fiscal por hijos. Estos dos legisladores justificaron el nuevo ataque al crédito rembolsable basándose en parte en la representación de un solo preparador de impuestos - autoproclamado denunciante – quien afirma que el fraude está generalizado en el programa. De manera consciente o muy probablemente de manera inconsciente, la historia que contó este supuesto denunciante es también un reconocimiento de que él mismo cometió un fraude fiscal evidente y flagrante, lo cual es un delito grave penado con una sanción de hasta tres años de privación de libertad y una multa de 250,000 dólares. Teniendo en cuenta las afirmaciones del preparador de impuestos sobre el abuso programático y dado su propio reconocimiento del fraude, es de suponer que estos senadores estarían enfocados en su erradicación. Sin embargo, ninguno de los proyectos de ley aborda la cuestión del fraude o el abuso del programa. Por el contrario, Vitter y Rubio han empleado la clásica táctica de atraer con señuelo para luego engañar. Han utilizado las inquietudes que existen sobre el abuso (inquietudes que ellos mismos han ayudado a sensacionalizar) para justificar una agenda totalmente diferente: la restricción drástica de la elegibilidad de millones de hijos de familias de bajos ingresos. Seamos claros. El argumento central que se utiliza para justificar estos proyectos de ley es que los contribuyentes indocumentados han reclamado ilegalmente miles de millones de dólares en créditos fiscales. Es claramente demostrable que ese argumento es falso, como se describe más abajo en la destrucción de los cuatro mitos principales sobre los inmigrantes y el crédito tributario por hijos. Mito No. 1: en el 2010 los contribuyentes indocumentados reclamaron ilegalmente 4,200 millones de dólares en créditos tributarios por hijos El Congreso aprobó por primera vez en 1997 el crédito tributario por hijos con el apoyo abrumador de la mayoría republicana como parte de la Ley de Alivio Tributario, crédito tributario por hijos que está destinado a beneficiar a los hijos y a ayudar a impedir que estos caigan en la pobreza. El derecho a solicitar el crédito está vinculado al hijo y no al padre. El hijo por el que se reclama el crédito debe ser menor de 17 años, ser dependiente legal del contribuyente, haber vivido con el contribuyente durante más de la mitad del año y ser ciudadano estadounidense, haber nacido en los EE.UU o ser un extranjero residente. El código fiscal requiere de forma explícita la documentación de la ciudadanía o residencia del hijo, pero no la del reclamante. Los trabajadores indocumentados que pagan impuestos de nómina y declaran sus impuestos utilizando un Número de Identificación Individual de Contribuyente, o ITIN (que se utiliza para personas que no son elegibles para recibir números de Seguro Social a efectos de declarar impuestos federales), no están cometiendo fraude al reclamar el crédito tributario por hijos a nombre de sus hijos que viven con ellos en los EE.UU. De hecho, están cumpliendo tanto con la letra como con el espíritu de la ley. Mito No. 2: El dinero de los contribuyentes se les está dando a niños que viven en otros países o a hijos que no son dependientes de los reclamantes. Los formularios de impuestos que deben presentarse para reclamar el crédito tributario por hijos exigen la entrega del número de Seguro Social del hijo o su ITIN como prueba de que es ciudadano estadounidense, nacido en los EE.UU. o extranjero residente. También, el hijo debe haber vivido con el contribuyente durante más de la mitad del año para ser elegible a obtener el crédito. Además, si más de un declarante trata de reclamar por el mismo hijo, se activa una auditoría automática por parte del Servicio de Rentas Internas (IRS por sus siglas en ingles). No existe evidencia de que se presenten con frecuencia las susodichas reclamaciones dobles y, de presentarse, se resolverían a través de una auditoria ejecutoria. Asimismo, cuando los declarantes tratan de reclamar deducciones sospechosas como la reclamación de un gran número de dependientes, las declaraciones de impuestos se señalan para auditoria. Es probable que una reclamación de esa índole hecha por un declarante de bajos ingresos sea revisada antes de que se administre el rembolso. De haber casos en los que un contribuyente reclama créditos a nombre de hijos que viven fuera de los EE.UU. o que están siendo reclamados por otras personas, eso es un abuso del programa y debe ser sancionado mediante medidas coercitivas por parte del IRS. La posible existencia de algún fraude o abuso no justifica que se restrinja un programa que ha evitado de forma eficaz que los niños de bajos recursos caigan en la pobreza. Es más, existen abusos generalizados y más costosos en otras áreas del código tributario. Mito No. 3: Los inmigrantes indocumentados están recibiendo enormes cheques de rembolso debido al crédito tributario por hijos y se están enriqueciendo gracias a eso. El ingreso familiar promedio de los declarantes sin número de Seguro Social que reclamaron el rembolso adicional por crédito tributario por hijos en 2010 fue de unos $21,240, menos de la mitad del ingreso medio en los EE.UU el año pasado. Y, según el Departamento del Tesoro de los Estados Unidos, el reembolso promedio por crédito tributario por hijos fue de unos $1,800, lo cual exigiría tener por lo menos dos hijos dependientes. Incluso para las familias de bajos ingresos y las que viven en comunidades rurales, el costo anual de la crianza de un hijo es de unos $10,000 por año, de modo que cualquier afirmación de que los inmigrantes se están “haciendo ricos” es, en el mejor de los casos, errónea. Si la inquietud real es que el fraude o abuso tributario está drenando las arcas del Tesoro, es curioso que los Senadores Vitter y Rubio hayan decidido centrar su atención en este programa en particular. En el mejor de los casos, el abuso ascendería a millones de dólares en ingresos perdidos, que es solo una pequeña cantidad de los $4,200 millones de los declarantes de impuestos con un ITIN. Con todo, eso no quiere decir que el monto sea insignificante y todos podemos convenir en que cualquier caso de fraude debería erradicarse necesariamente. Pero si lo que preocupa es la cuenta bancaria de la nación, tendría mucho más sentido priorizar la recuperación de los ingresos comerciales y corporativos no reportados, que ascendieron a más de $170,000 millones en el 2006 (el último año sobre el que hubo datos). Mito No. 4: La única forma de evitar el abuso del crédito tributario por hijos es restringir la elegibilidad solo a hijos ciudadanos o hijos de padres ciudadanos. Los proponentes de la restricción de la elegibilidad al crédito fiscal por hijo quieren tirar al bebé junto con el agua de baño, atacando un crédito que ha sido diseñado para ayudar a las familias de bajos y moderados ingresos y no para perseguir su uso fraudulento. Además, restringir la elegibilidad afectaría de manera grave y desproporcionada a las personas de color. Por ejemplo, es más probable que los hijos de latinos vivan en la pobreza que cualquier otro grupo racial o étnico y más de la mitad de los 6,1 millones de niños latinos que viven en la pobreza son hijos nacidos en los EE.UU. de padres inmigrantes. Empujar a un mayor número de niños aún más hacia la pobreza no seria la solución a nuestros problemas económicos. Una forma más puntual de limitar el fraude sería exigirle a los que preparan los impuestos que pidan prueba de residencia del niño antes de presentar en forma electrónica una declaración de impuestos. La lucrativa industria de la preparación de impuestos debería llevar el peso de la obligación de documentar la residencia de los niños porque, en muchos casos, las personas que preparan los impuestos son culpables de que se presenten reclamaciones falsas. Exigirles a los que preparan las declaraciones de impuestos que pidan la documentación correspondiente no impondría ninguna carga al IRS y ayudaría al gobierno a asegurar que los que preparan los impuestos sean diligentes. Conclusión Lamentablemente, los intentos actuales de restringir la elegibilidad del crédito fiscal por hijos sigue una larga línea de propuestas que se encuentran actualmente ante el Congreso con el fin de compensar los gastos gubernamentales eliminando servicios que se prestan a los estadounidenses de bajos ingresos (en este caso a los hijos nacidos en los EE.UU. de padres inmigrantes) en vez de recurrir a los estadounidenses más ricos que pueden pagar más. Quitarle este importante programa a los niños que les ha tocado por casualidad tener padres indocumentados no será la solución al problema del fraude fiscal ni resolverá la crisis de la deuda, pero sí perjudicará de manera significativa a algunos de nuestros ciudadanos más vulnerables. Separating Fact from Fiction About the Child Tax Credit
Attacks Against the Child Tax Credit Suggest Compassionate Conservatism is Dead
By Marshall Fitz , Sarah Jane Glynn Immigrants and the child tax credit—the refundable credit enacted by Congress in 1998 to keep children from falling into poverty—are back in the news again. This time the claims being leveled are even more hyperbolic and misleading than before. Sens. David Vitter (R-LA) and Marco Rubio (R-FL) recently introduced separate legislation seeking to limit eligibility for the tax credit and are actively politicizing the issue while pushing for a Senate vote. The bills purportedly aim to block undocumented individuals from receiving a child tax credit. These two legislators have justified the renewed attack on this refundable credit based in part on the representation of a lone tax preparer—a self-proclaimed whistleblower—who claims fraud is rampant in the program. Wittingly, or most likely not, the story told by this purported whistleblower is also an admission that he himself committed obvious and blatant tax fraud—a felony punishable by up to three years in prison and a $250,000 fine. Given the tax preparer’s claims of programmatic abuse and given his own admission of fraud, one would assume these senators would be focused on rooting it out. Yet neither bill tackles the question of fraud or abuse in the program. Instead, Vitter and Rubio have pulled a classic bait and switch. They have used concerns about abuse (concerns that they have helped sensationalize) to justify another agenda entirely: drastically restricting eligibility to millions of children in low-income families. Let’s be clear. The central talking point being used to justify these bills is that billions of dollars in tax credits are being unlawfully claimed by undocumented tax filers. As we describe below in debunking the top four myths about immigrants and the child tax credit, that argument is patently and demonstrably false. account, it would make much more sense to prioritize recouping unreported business and corporate income, which was more than $170 billion in 2006 (the latest year for which there are data). Myth No. 4: The only way to prevent abuse of the child tax credit is to restrict eligibility to only citizen children or children with citizen parents Proponents of restricting eligibility to the child tax credit want to throw the baby out with the bathwater, attacking a credit designed to help low- and moderate-income families, rather than going after fraudulent usage. Further, restricting eligibility would heavily and disproportionately impact people of color. Latino children, for example, are more likely to live in poverty than any other racial or ethnic group and more than half of the 6.1 million Latino children in poverty are the U.S.-born children of immigrants. Pushing a greater number of children even further into poverty is hardly the solution to our economic problems. A more targeted way to limit the fraud would be to require paid tax preparers to obtain proof of residency of the child prior to electronically filing a tax return. The for-profit tax preparation industry should bear the burden of documenting residency of the children because the preparers, in many cases, are to blame for the false claims. Requiring preparers to obtain the documentation would not impose any new burden on the IRS and would assist the government in ensuring that tax preparers are diligent. Conclusion Sadly, the current attempts to restrict eligibility for the child tax credit follow in a long line of proposals in the current Congress that seek to offset governmental costs by taking away services from lowincome Americans (in this case the U.S.-born children of immigrant parents) rather than looking to the wealthiest Americans who can well afford to pay more. Taking away this important program from children who just happen to have undocumented parents will not fix the problem of tax fraud or solve the debt crisis, but it will significantly harm some of our most vulnerable citizens. Myth No. 1: $4.2 billion in child tax credits was illegally claimed by undocumented immigrants in

2010 First passed by Congress in 1997 with overwhelming Republican support as part of the Taxpayer Relief Act, the child tax credit is intended to benefit children and to help keep them from falling into poverty. Eligibility to claim the credit is tied to the child and not to the parent. The child being claimed must be under the age of 17, a legal dependent of the tax filer, have lived with the filer for more than half of the year, and be a U.S. citizen, a U.S. national, or a U.S. resident alien. The tax code explicitly requires documentation of the child’s citizenship or residency, but not the claimant’s. Undocumented workers who contribute payroll taxes and file their taxes using an Individual Taxpayer Identification Number, or ITIN (used for people who are not eligible for a Social Security number to file their taxes), are not committing fraud by claiming the child tax credit for their children living with them in the United States. They are in fact complying with both the letter and the intent of the law. Myth No. 2: Taxpayer dollars are being given to children living in other countries or children who are not the dependents of the claimants The tax forms that must be filed in order to claim the child tax credit require the submission of the child’s Social Security number or ITIN that proves they are a U.S. citizen, a U.S. national, or a U.S. resident alien. The child must also have lived with the filer for more than half of the year in order to be eligible for the credit. Additionally, if more than one filer attempts to claim the same child, an automatic audit is triggered by the Internal Revenue Service. There is no evidence that such double claiming occurs frequently and, in any case, it will be resolved via an enforcement audit. Further, tax returns are flagged for audits when filers attempt to claim suspicious deductions such as claiming a large number of dependents. A low-income filer who files such a claim would likely be reviewed before a refund is administered. If there are instances of filers claiming credits for children who are living outside the United States or who are being claimed by others, that is an abuse of the program and should be penalized through IRS enforcement. The possible existence of some fraud or abuse does not justify restricting a program that has effectively kept low-income children from slipping into poverty. What’s more, there is far more costly and rampant abuse in other areas of the tax code. Myth No. 3: Undocumented immigrants are receiving huge refund checks due to the child tax credit and are getting rich from it The average household income for filers without a Social Security number claiming the additional child tax credit refunds in 2010 was about $21,240, less than half the median income in the United States that year. And according to the U.S. Treasury Department, the average child tax credit refund was about $1,800, which would require at least two dependent children. Even for lower-income families and those living in rural communities, the annual cost of raising a child is around $10,000 per year, so any claim that immigrants are “getting rich” is erroneous at best. If the real concern is that tax fraud or abuse is draining the Treasury’s coffers, it is curious that Sens. Vitter and Rubio elected to target their focus on this particular program. At most, the abuse would amount to millions of dollars in lost revenue, which is only a small portion of the $4.2 billion claimed by ITIN filers. That is not to say the amount is insubstantial, however, and we can all agree that any instance of fraud should necessarily be rooted out. But if the concern is truly about the nation’s bank
