The federal Fair Labor Standards Act sets the minimum wage, overtime pay, recordkeeping and youth employment standards for the nation s workers. In addition to federal standards, Arizona also has its own employment regulations. Minimum Wage As of January 2010, the minimum wage for non-exempt Arizona employees is $7.25 per hour. Exempt employees include family members, babysitters, state and federal employees, independent contractors and employees of small businesses with annual gross revenue less than $500,000. Overtime Pay All non-exempt employees must receive at least 1.5 times the usual hourly rate for hours worked in excess of 40 hours in a seven-day work week. Youth Employment Professions Arizona employees under 18 are prohibited from working in manufacturing, construction and other professions deemed unsafe for minors. Youth Employment Hours Arizona employees under 16 are restricted to the number of hours they can work. When school is in session, workers younger than 16 years old cannot work more than 18 hours or between the hours of 9:30 p.m. and 6 a.m. before a school night. When school is out, workers under 16 can work up to 40 hours per week. Recordkeeping Every employer is required to keep accurate records regarding each employee s hours and wages for at least three years.
